PLANNING COMMISSION RESOLUTION NO. 3208
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNLA, RECOMMENDING
PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF
PALOMAR AIRPORT ROAD EAST OF PASEO DEL NORTE.
APPROVAL OF A ZONE CHANGE FROM P-M-Q TO C-2-Q ON
CASE NAME; PRICE CLUB
CASE NO.; ZC 90-1
WHEREAS, a verified application for certain property, to wit:
Parcel "A" of Parcel Map No. 2949, together with a Portion
of Lot "H" of the Rancho Agua Hedionda, Map No. 823, in
the City of Carlsbad, County of San Diego, State of California
lo 11 has been filed with the City of Carlsbad, and referred to the Planning Commission; and
l1 I/ WHEREAS, said application constitutes a request as provided by Title 21 of

13 the Carlsbad Municipal Code; and

testimony and arguments, if any, of all persons desiring to be heard, said Commission I'
WHEREAS, at said public hearing, upon hearing and considering all 16
hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, the Planning Commission did on the 3rd day of April, 1991,
l8 j( considered all factors relating to the Zone Change; and

20 I) NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission
21 as follows:
22 A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Commission
recommends APPROVAL of ZC 90-1 according to "Exhibit X' attached hereto and
based on the following findings and subject to the following conditions.

1. The proposed Zone Change to C-2-Q is consistent with all applicable policies and 27 guidelines in the Land Use Element of the General Plan as discussed in the staff
28 report for the project.

2. The proposed change in zoning designation from P-M-Q to C-2-Q is consistent with
1 the General Plan and will achieve consistency between the General Plan and
2 II Zoning as required by State Law and the Land Use Element.

4. The Q- Overlay Zone, made a part of the proposed Zone Change, provides the City 5
uses.
with discretionary review over development of the site to assure that allowed uses
are compatible with surrounding land uses.

3. The commercial uses allowed by the proposed Zone Change to C-2-Q would be
compatible with the adjacent existing and permitted future non-residential land
5. AU findings of the Conditional Negative Declaration, Resolution No. 3205, and
8 SDP 90-5, Resolution No. 3209, are incorporated herein by reference.

1. All conditions of .the Conditional Negative Declaration, Resolution No. 3205, GPA
90-1, LCPA 90-2, SDP 90-5, CUP 90-3, HDP 90-9 and MS 837 are incorporated
herein by reference. Refer to those documents for all conditions and mitigation
12 measures applicable to the development of the Price Club project site.

2. Approval of ZC 90-1 is granted subject to the approval of the Conditional Negative
Declaration, GPA 90-1 and LCPA 90-2.

The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION I: That Title 21 of the Carlsbad Municipal Code
is amended by the amendment of a zoning map as shown on the map
marked IIExhibit Zgv attached hereto and made a part hereof.
SECTION 11: That the findings and conditions of the
Planning Commission as set forth in Planning Commission Resolution
13 3208 constitutes the findings and conditions of the City Council.
14 EFFECTIVE DATE: This ordinance shall be effective
15 thirty days after its adoption, and the City Clerk shall certify
16 to the adoption of this ordinance and cause it to be published at

least once in the Carlsbad Journal within fifteen days after its
