CASE NAME: PI0 PICO MEDICAL BUILDING DEVELOPMENT PLAN SDP 90-10 TO CONSTRUCT AN 8,595 CASE NO. SDP 90-10 6 7 WHEREAS, a verified application has been filed with the City of Carlsbad an( 8 referred to the Planning Commission; and 9 WHEREAS, said verified application constitutes a request as provided by TitL lo 11 21 of the Carlsbad Municipal Code; and 11 12 WHEREAS, pursuant to the provisions of the Municipal Code, the Plannin; 13 II Commission did, on the 3rd day of April, 1991, and on the 17th day of April, 1991 14 II consider said request on property described as: 15 16 17 A portion of Lot 4 in Section 31, Township 11 South, Range 4 West, in the City of Carslbad, County of San Diego, State of California, according to the Official Plat thereof. The proposed development is consistent with the General Plan and the "Profession: and Related Commercial" land use designation because the General Plan states tlx office and professional uses are compatible with the office (0) designatioa 2. The site is physically suitable for the type and density of the development since th site is adequate in size and shape to accommodate the 8,595 sq. ft. officc development. 3. The Planning Commission has, by inclusion of an appropriate condition to thi project, ensured building permits will not be issued for the project unless the Cic Engineer determines that sewer service is available, and building cannot occu within the project unless sewer service remains available, and the Plannin; Commission is satisfied that the requirements of the Public Facilities Element of thl General Plan have been met insofar as they apply to sewer service for this projecl 4. AU necessary pub& Aprovements have been provided or will be required a conditions of approval. 5. The applicant has agreed and is required by the inclusion of an appropriatc condition to pay a public facilities fee. Performance of that contract and paymen; of the fee will enable this body to find that public facilities will be availablt concurrent with need as required by the General Plan. 6. Assurances have been given that adequate sewer for the project will be provided bl the City of Carlsbad. 7. The proposed project is compatible with the surrounding future land uses sincc surrounding properties are designated for office and professional development on the General Plan. I ' 8. This project will not cause any significant environmental impacts and a Negative APPROVED by the Planning Commission on April 17, 1991. In approving thk Negative Declaration the Planning Commission has considered the initial study, the staff analysis, all required mitigation measures and any written comments received regarding the significant effects this project could have on the environment. 9. The applicant is by condition, required to pay any increase in public facility fee, 01 new construction tax, or development fees, and has agreed to abide by any additional requirements established by a Local Facilities Management Plan prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensure continued availability of public facilities and will mitigate any cumulative impacts created by the project. i Declaration has been issued by the Planning Director on January 16, 1991 and PC RES0 NO. 3201 -2- I/ 0 e 1 10. This project is consistent with the City's Growth Management Ordinance as it ha been conditioned to comply with any requirement approved as part of the Loca 2 Facilities Management Plan for Zone 1. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 Conditions: 1. Approval is granted for SDP 90-10, as shown on Exhibit(s) "A" - "E", dated Marc1 1, 1991, incorporated by reference and on file in the Planning Departmeni Development shall occur substantially as shown unless otherwise noted in thes' conditions. 2. The developer shall provide the City with a reproducible 24" x 36", mylar copy 0. the Site Plan as approved by the Planning Commission. The Site Plan shall reflec the conditions of approval by the City. The Site Plan copy shall be submitted to thc City Engineer prior to issuance of building permits or improvement plan submittal whichever occurs first. 3. This project is approved upon the express condition that building permits will no be issued for development of the subject property unless the City Enginee: determines that sewer facilities are available at the time of application for sucl sewer perrnits and will continue to be available until time of occupancy. 4. This project is also approved under the express condition that the applicant pay thc public facilities fee adopted by the City Council on July 28, 1987 and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvemenl plan and to fulfill the subdivider's agreement to pay the public facilities fee dated June 12, 1990, a copy of which is on file with the City Clerk and is incorporated bj this reference. If the fees are not paid this application will not be consistent witk the General Plan and approval for this project will be void. 5. Water shall be provided to this project pursuant to the Water Service agreemenl between the City of Carlsbad and the Carlsbad Municipal Water District, dated MaJ 25, 1983. 22 6. This project shall comply with all conditions and mitigation required by the Zonc 1987, incorporated herein and on file in the Planning Department and any future 23 1 Local Facilities Management Plan approved by the City Council on September 1, 24 amendments to the Plan made prior to the issuance of building permits. 25 7. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on 26 27 PC RES0 NO. 3201 -3- 28 0 0 1 2 this project are challenged this approval shall be suspended as provided i~ Government Code Section 65913.5. Approval of this request shall not excuse compliance with all sections of the Zonin; Ordinance and all other applicable City ordinances in effect at time of buildiq permit issuance. The developer shall install street trees at the equivalent of 40-foot intervals don1 4 trees shall be of a variety selected from the approved Street Tree List. all public street frontages in conformance with City of Carlsbad standards. All landscape plans shall be prepared to conform with the Guidelines Manual anc submitted per the landscape plan check procedures on file in the Planninj Department. 22. Landscape plans shall be designed to minimize water use. Lawn and other zone I plants (see Guidelines Manual) shall be limited to areas of special visual importancr or high use. Mulches shall be used and irrigation equipment and design shal promote water conservation. 23. The developer shall avoid trees that have invasive root systems, produce excessivt litter and/or are too large relative to the lot size. 24. Planter width shall be a minimum of four (4) feet, not including curb, footing: and/or other paving, and parking overhang. 14 25. Prior to final occupancy, a letter from a California licensed landscape architect shal 15 be submitted to the Planning Director certifying that all landscaping has beer 16 l? 18 19 27. The applicant shall pay a landscape plan check and inspection fee as required b; 20 21 installed as shown on the approved landscape plans. 26. All herbicides shall be applied by applicators licensed by the State of California. Section 20.08.050 of the Carlsbad Municipal Code. 28. The first set of landscape and irrigation plans submitted shall include building plans improvement plans and grading plans. 29. The minimum shrub size shall be 5 gallons. 33. 30% of trees in industrial and commercial projects shall be 24" box or greater. 34. Any signs proposed for this development shall at a minimum be designed conformance with the City's Sign Ordinance and shall require review and approv of the Planning Director prior to installation of such signs. 35. A uniform sign program for this development shall be submitted to the Plannin Director for his review and approval prior to occupancy of any building. 36. Building identification and/or addresses shall be placed on all new and existin buildings so as to be plainly visible from the street or access road; color ( identification and/or addresses shall contrast to their background color. 37. Prior to occupancy the applicant shall construct a directory sign at the entrance I the project. The design of this sign shall be approved by the Planning Director, 38. As part of the plans submitted for any permit plan check, the applicant shall inclua a reduced, legible version of the approving resolution/resolutions on a 24" x 36 blueline drawing. Said blueline drawing(s) shall also include a copy of an applicable Coastal Development Permit and signed approved site plan. 39. Prior to issuance of a grading or building permit, whichever comes first, a soil report shall be prepared and submitted to the City of Carlsbad. If the soils repol indicates the presence of potential fossil bearing material then a standard tw phased program, on file in the Planning Department, shall be undertaken to avoi, possible significant impacts on paleontological resources under the direction of th Planning Department. .I.[ I1 18 EnRineerinn Conditions: 19 40. The developer shall be responsible to pay the recording fees for ~II agreements 2o I easements and documents required for this project. 21 22 23 24 25 26 27 28 41. Unless a standard variance has been issued, no variance from City Standards i authorized by virtue of approval of this site plan. 42. The developer shall comply with all the rules, regulations and design requirement of the respective sewer and water agencies regarding services to the project. 43. The developer shall be responsible for coordination with S.D.G.&E., Pacific Telephone, and Cable TV authorities. PC RES0 NO. 3201 -6- e 0 44. This project is approved specifically as 1 (single) phase. 45. Based upon a review of the proposed grading and the grading quantities shown 01 the site plan, a grading permit for this project is required. Prior to issuance of i building permit for the project, the applicant must submit and receive approval fo grading plans in accordance with City codes and standards, be issued a gradin; permit and complete the grading work in substantial conformance with th( approved grading plans. 48. The developer shall obtain a grading permit prior to the commencement of q clearing or grading of the site. 49. A separate grading plan shall be submitted and approved and a separate gradin2 permit issued for the borrow or disposal site if located within the city limits. 50. No grading shall occur outside the limits of the project unless a grading or slop€ easement is obtained from the owners of the affected properties, If the develope] is unable to obtain the grading or slope easement, he must either amend the typc of permit or change the slope so grading will not occur outside the project site ir a manner which substantially conforms to the approved Site Plan as determined bj the City Engineer and Planning Director. 51. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City conditions and requirements the City Engineer may impose with regards to the hauling operation.
