CASE NAME: LA COSTA HOTEL & SPA CASE NO: SUP 90-12 WHEREAS, a verified application for certain property, to wit: Lot 3 La Costa Condominium unit 4 and a Parcel of land being a portion of Lot 14, Section 35, Township 12 South, Range 4 West, San Bernardino Meridian in that City of Carlsbad, in the County of San Diego, State of California, according to the official plot. has been filed with the City of Carlsbad, and referred to the Planning Commission; an WHEREAS, said application constitutes a request as provided by Title 21 of th Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 17th day of April, 1991, hold duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony an arguments, if any, of all persons desiring to be heard, said Commission considered a factors relating to the Special Use Permit; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission ( the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. The developer shall comply with all the rules, regulations and design requkemen, 9 of the respective sewer and water agencies regarding services to the project. 'LO 11 12 13 14 14. The developer shall be responsible for coordination with S.D.G.&E., PaciE Telephone, and Cable TV authorities. 15. Prior to hauling dirt or construction materials to any proposed construction sit within this project the developer shall submit to and receive approval from the Cit Engineer for the proposed haul route. The developer shall comply with a conditions and requirements the City Engineer may impose with regard to th hauling operation. 15 16. The developer shall exercise special care during the construction phase of th 16 17 project to prevent offsite siltation. Prior to issuance of a grading pexmit the developer shall enter into a Futw Improvement Agreement for the design and construction of improvements on 1 Camino Real and La Costa Avenue as follows: A. El Camino Real to one-half width prime arterial street standards plus fu width median along the project frontage of the parcel on which the projec is located, APN: 216-123-06. B. Any or all of the above improvements shall be constructed at such he as require by City Engineer. 19. Plans, specifications and supporting documents for all improvements shall E prepared to the satisfaction of the City Engineer. Prior to issuing a grading perm the applicant shall install, or agree to install and secure with appropriate securil as provided by law the following improvements to City Standards to th satisfaction of the City Engineer. A. A N1 intersection traffic signal at El Camino Real and Costa Del Mar Roa (private) with a hard wire traffic signal interconnect and equipma between Costa Del Mar and La Costa Avenue. B. Sidewalks along the east side of El Camino Real from Costa Del Mar Roa to the southerly limits of APN Parcel No. 216-123-06. 20. Construction of the sidewalks shall be completed within one year from the date ( project approval and shall be secured accordingly. Construction of the traff: signal shall be at such time as required by the City Engineer. 21. Prior to issuance of a grading permit the developer shall propose for the approu of the City Engineer and Planning Director a system of signs and warnings ( possible flooding of the parking lot. Water DeDartment Conditions: 22. This project is approved upon the expressed condition that the grading permits wj not be issued for development of subject property unless the Water District servin the development determines that adequate water and service and will continue 1 be available until time of occupancy and/or use. 23. The developer shall be required to install a reclaimed water system and faditit to serve the parking lot as directed by the District Engineer. ...I .... "" "" ....
