CASE NAME: LA COSTA HOTEL AND SPA CASE NO: SUP 90-13 WHEREAS, a verified application for.certain property, to wit: Lot 3 La Costa Condominium Unit 4 and a Parcel of land being a portion of Lot 14, Section 35, Tomhip 12 South Range 4 West, San Bernardino Meridian in that City of Carlsbad, in the County of San Diego, State of California, according to the official plot. lo // has been filed with the City of Carlsbad, and referred to the Planning Commission; and 11 li WHEREAS, said application constitutes a request as provided by Title 21 of the 12 II I/ Carlsbad Municipal Code; and 13 14 15 WHEREAS, at said public hearing, upon hearing and considering all testimony and 16 duly noticed public hearing as prescribed by law to consider said request; and 18 arguments, if any, of all persons desiring to be heard, said Commission considered all l7 WHEREAS, the Planning Commission did on the 17th day of April, 1991, hold a factors relating to the Special Use Permit; and 19 I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of 20 21 /i the City of Carlsbad as follows: 22 ' A) That the foregoing recitations are true and correct. 23 24 B) That based on the evidence presented at the public hearing, the Commission APPROVES SUP 90-13, based on the following findings and subject to the following conditions: 25 26 27 28 .... .... 0 e 11 Findings : - I 1. The project protects scenic views and traffic safety along El Camino Real by 3. All necessary public improvements have been provided or will be required as 6 Camino Real. 5 providing landscaped berms and by contributing to a landscaped median in El setback, bemhg and landscape screening- 7 conditions of approval. 8 4. The proposed project is compatible with the surrounding future land uses since on the General Plan. 9 surrounding properties are designated for residential and commercial development lo 11 5. This project will not cause any simcant environmental impacts and a Conditional and APPROVED by the Planning Commission on April 17,1991. In approving this Negative Declaration has been issued by the Planning Director on March 7, 1991 environment. 14 comments received regarding the significant effects this project could have on the 13 initial study, the staff analysis, required mitigation measure, and any written 15 Conditions: 16 1.
