HomeMy WebLinkAbout1991-05-15; Planning Commission; Resolution 3224e 0 1 2 3 4 5 6 PLANNING COMMISSION RESOLUTION NO. 3224 A RESOLUTION OF THE PLANNIN~ COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AMENDMENT TO A SITE DEVELOPMENT PLAN ALLOWING THE REMOVAL OF A PARCEL FROM THE EXISTING PLAN ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF IMPALA DRTVE AND ORION WAY CASE NAME: BALDWIN ENGINEERING CASE NO: SDP 78-1(D) 7 8 referred to the Planning Commission; and WHEREAS, a verified application has been filed with the City of Carlsbad and 9 WHEREAS, said verified application constitutes a request as provided by Title lo 21 of the Carlsbad Municipal Code; and XI. /I WHEREAS, pursuant to the provisions of the Municipal Code, the Planning 12 13 14 Commission did, on the 15th day of May, 1991, consider said request on property described as: 15 16 A resubdivision of Parcel 2 of Parcel Map No. 10060 filed in San Diego County on May 23, 1980; 17 I/ WHEREAS, at said public hearing, upon hearing and considering all testimony 18 19 factors relating to SDP 78-1(D). and arguments, if any, of all persons desiring to be heard, said Commission considered all 20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission 21 22 of the City of Carlsbad as follows: 23 A) That the foregoing recitations are true and correct. The existing development is still properly related to the site, surroundings, and environmental setting, consistent with the various elements of the general plan, not detrimental to existing uses or to uses specifically permitted in the area, and not the subject parcel because the subject parcel is not related to the existing 4 5 detrimental to the site, surroundings, or traffic circulation, despite the removal of devleopment with respect to parking or circulation. 6 7 8 9 10 11 12 2. 3. ~ The existing development site is still adequate in size and shape to accommodate the existing development because the proposed project complies with all applicable ordinances regarding site development standards while keeping with the existing constraints of the site, therefore not requiring adjustments to the existing development. All yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the proposed development to existing or permitted future uses in the neighborhood will be provided and maintained as the site design is compatible with neighboring developments and all existing and proposed landscaped areas are conditioned to be provided and to remain intact. l3 14 4. The street system serving the existing development is still adequate to properly handle all traffic generated by the proposed development as the site is served by fully improved, local streets that are not proposed to change with the new 15 development. 16 Conditions: I" 1. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. 3. Approval of SDP 78-1(D) is granted subject to the approval of SDP 91-4.
