CASE NAME: VISTA/CARLSBAD SEWER INTERCEPTOR IN THE RIGHTS-OF-WAY OF JEFFERSON STREET, OAK CASE NO.: PCD/GPC 90-13 WHEREAS, the Planning Commission did on the 15th day of May, 1991, consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Planning Commission Determination; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission APPROVES PCD/GPC 90-13, based on the following findings and subject to the following conditions: Findings: 1. The Vista/carlsbad Interceptor project is consistent with the Land Use and Pubk Facilities Ezements of the General Plan as required by Section 65401 of the California Government Code. 2. The planning Director has determined that the project will not have a significanl adverse impact on the environment and has issued a Negative Declaration ox December 28, 1990. Conditions: 1. Approval is granted for PCD/GPC 90-13, as shown on Exhibit(s) "A" - "R", datec May 15, 1991, incorporated by reference and on file in the Planning Department Development shall OCCUT substantially as shown unless otherwise noted in thest conditions. Prior to issuance of a right-of-way pennit, a Coastal Development Permit shall be obtained from the California Coastal Commission. 3. Approval of PCD/GFC 90-13 is granted subject to approval of RP 90-6 and CDP 90-3. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 15th day of May, 1991, by the following vote, to wit: AYES: Chairperson Holmes, Commissioners: Schlehuber, Schramm: Savary, Noble, Erwin & Hall.
