PLANNING COMMISSION RESOLUTION NO. 3239
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A HILLSIDE
DEVELOPMENT PERMIT ON PROPERTY GENERALLY
LOCATED ON THE WEST SIDE OF EL CAMINO REAL
BETWEEN KELLY DRIVE AND HIDDEN VALLEY ROAD.
CASE NAME: RANCHO REAL
CASE NO: HDP 90-19
WHEREAS, a verified application for certain property to wit: That the
portion of Lot "I" of Rancho Aqua Hedionda, in the City of Carlsbad, County of San Diego,
State of California, according to the partition map thereof No. 823 filed in the office of
the County Recorder of San Diego County, November 16, 1896, has been filed with the
City of Carlsbad and referred to the planning Codssion; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 29th day of May, 1991,
consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all
factors relating to the Planning Commission Determination; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission
as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission
APPROVES HDP 90-19, based on the following findings and subject to the
following conditions:

Findinns:
1. All of the findings of Resolution 3238, CT 90-13, are hereby incorporated by
reference.
2. The project will assure that hillside alteration will not result in substantial damage
or alteration of significant natural resource areas, wildlife habitats, or native
vegetation areas.
3. The project will preserve the natural appearance of hillsides by assuring that
development density and intensity relates to the slope of the land and is
compatible with hillside preservation.

4. The project will assure proper design is utilized in grading, landscaping and in the
development of structures and roadways to preserve the ~tural appearance of
hillsides.
5. The project will assure hillside conditions are properly identified and incorporated
into the planning process.
6. The project will prevent erosion and protect the lagoons from excessive siltation.
Conditions:
1. Approval is granted for HDP 90-19, as shown on Exhibits ttA"-'T' dated May 2,
1991, incorporated by reference and on file in the Planning Department.
Development shall occur substantially as shown unless otherwise noted in these
conditions.
2. Approval of HDP 90-19 is granted subject to the approval of Cl" 90-13, PUD 90-
16, and SUP 90-7.
3. All of the conditions of Resolution No. 3238, CT 90-13, are hereby incorporated
by reference.
