HomeMy WebLinkAbout1991-05-29; Planning Commission; Resolution 3240*" c 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 3240 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNED UNIT DEVELOPMENT PERMIT ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF EL CAMINO REAL BETWEEN KELLY DRIVE AND HIDDEN VALLEY ROAD. CASE NAME: RANCHO REAL CASE NO: PUD 90-16 WHEREAS, a verified application for certain property to wit: That the portion of Lot "I" of Rancho Aqua Hedionda, in the City of Carlsbad, County of San Diego, State of California, according to the partition map thereof No 823 filed in the office of the County Recorder of San Diego County, November 16, 1896, has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 29th day of May, 1991, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Tentative Tract Map and Planned Unit Development. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission APPROVES PUD 90-16, based on the following findings and subject to the followhg conditions: ... -* * * 0 Findings: 1 2 reference. 1. All of the findings of Resolution 3238, CI' 90-13, are hereby incorporated by 3 4 5 6 7 2. The granting of this permit will not adversely affect and will be consistent with this code, the general plan, applicable specific plans, master plans, and all adopted plans of the city and other govemmental agencies. 3. The proposed use at the particular location is necessary and desirable to provide a service or facility which will contribute to the long-term general well-being of the neighborhood and the community. 8 4. Such use will not be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the 9 vicinity. lo 5. The proposed planned development meets or exceeds all of the minimum 11 development standards set forth in Section 21.45.090. 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 6. The proposed planned development meets all of the design criteria set farth in Section 21.45.080 and has been designed in accordance with the concepts contained in the design guidelines manual. 7. The proposed project is designed to be sensitive to and blend in with the natural topography of the site. 8. The proposed project's design and density of the developed portion of the site is compatible with surrounding development and does not create a disharmonious or disruptive element to the neighborhood. 9. The proposed project's circulation system is designed to be &cient and well integrated with the project and does not dominate the project. Conditions: 1. Approval is granted for PLJD 90-16, as shown on Exhibits llA1'-'T1, dated May 2, 1991, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. Approval of PUD 90-16 is granted subject to the approval of CT 90-13, HDP 90-19, and SUP 90-7.
