HomeMy WebLinkAbout1991-05-29; Planning Commission; Resolution 3252.. . - I1 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 3252 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAFUSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE CARLSBAD LOCAL COASTAL PLAN TO BRING THE DESIGNATIONS ON THE LOCAL COASTAL PLAN, GENERAL PLAN, AND ZONING MAP INTO CONFORMANCE ON PROPERTY LOCATED ON THE SOUTH SIDE OF ADAMS STREET BETWEEN HOOVER STREET AND HIGHLAND DRIVE, ON THE NORTH SHORE OF THE AGUA HEDIONDA LAGOON CASE NAME: LAGUNA POINT CASE NO: LCPA 90-4 WHEREAS, California State law requires that the Local Coastal Plan, General Plan, and Zoning designations for properties in the Coastal Zone be in conformance; WHEREAS, a verified application for an amendment to the Local Coastal Plan designations for certain property located, as shown on Exhibit "LCPA 90-4", dated May 29, 1991, attached and incorporated herein, has been filed with the Planning Commission; and WHEREAS, said verified application constitutes a request for amendment as provided in Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 29th day of May, 1991, hold a duly noticed public hearing as prescribed by law to consider the proposed Local Coastal Plan Amendments shown on Exhibit LCPA 90-4, and; WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Local Coastal Plan Amendment. .> /I 0 e 1 2 3 4 5 6 7 8 9 x0 I2 I WHEREAS, State Coastal Guidelines requires a six week public revie1 period for any amendment to the Local Coastal Program. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissic of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) At the end of the State mandated six week review period, starting c September 20, 1990, and ending on November 1, 1990, staff shall presel to the City Council a summary of the comments received. C) That based on the evidence presented at the public hearing, the Commissic recommends APPROVAL of LCPA 90-4 as shown on Exhibit "LCPA 90-4 dated May 29, 1991, attached hereto and made a part hereof based on 11 following findings: 12 13 14 15 16 3.7 18 19 1 20 21 22 23 24 Findins: 1. The proposed amendment to the Local Coastal Plan is consistent with the go: and all applicable policies of the Agua Hedionda segment of the Local Coast Program. 2. The proposed amendment to the Agua Hedionda segment of the Local Coast Program is required to bring the designations of the Local Coastal Progra~ General Plan, and Zoning Map into conformance. Conditions: 1. Approval of LCPA 90-4 is granted subject to the approval of GPA 90 and ZC 91-8 and is subject to all conditions of approval of GPA 90-4 and ZC 91 as contained in Planning Commission Resolution No's. 3251 and 325 incorporated herein by reference and on file in the Planning Department. 2. Approval of LCPA 90-4 is granted subject to approval of the proposed amendmer by the California Coastal Commission. I1 25 26 27 28 __ ....
