HomeMy WebLinkAbout1991-05-29; Planning Commission; Resolution 32531 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 e PLANNING COMMISSION RESOLUTION NO. 3253 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM RESIDENTIAL PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF ADAMS STREET BETWEEN HOOVER STREET AND HIGHLAND DRIVE ON THE NORTH SHORE OF THE AGUA HEDIONDA LAGOON CASE NAME: LAGUNA POINT TOURIST (R-T) TO ONE-FAMILY RESIDENTIAL (R-1-15) ON CASE NO: ZC 91-8 WHEREAS, a verified application for certain property, to wit: Lot 7 of Block "D" of Bella Vista, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 2152, fled in the Office of the County Recorder of San Diego County, March 7, 1989 has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 29th day of May, 1991, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZC 91-8 according to Exhibit "X" attached hereto and based on the following findings and subject to the following conditions. .. 0 0 1 Fhb: 2 Plan and Zoning as mandated by California State law and the City oj 5 1. The proposed Zone Change from Residential Tourist to One-Famill 3 4 residential is consistent with the goals and policies of the various element of the General Plan as demonstrated in the staff report for the project. 2. The proposed zone change will provide consistency between the Genera Carlsbad General Plan Land Use Element. 6 7 €3 3. The residential uses allowed by the proposed zone change are compatible with the existing and permitted uses in the area. 4- AU findings of GPA 90-2 and LCPA 90-4, Planning Commission Resolutio~ 9 NO'S- 3251 and 3252 apply to ZC 91-8 and are incorporated herein by 10 reference. 11 /j conditions: 12 13 14 15 16 17 18 1. Approval for ZC 91 -8 is granted subject to approval of GPA 90-2 and LCPA 90-4. ZC 91-8 is subject to all conditions of approval of GPA 90-2 and LCPA 90-4 as contained in Planning Commission Resolution No's. 3251 and 3252, incorporated herein by reference and on file in the Planning Department. 2. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 21 OF THE CARLSBAD MUNICIPAL CODE BY AN AMENDMENT TO THE ZONING MAP TO GRANT A R-T ZONE CHANGE, ZC 91-8, LAGUNA POINT, FROM R-T TO R-1-15 ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF ADAMS STREET BETWEEN HOOVER STREET AND HIGHLAND DRIVE.
