PLANNING COMMISSION RESOLUTION NO. 3257
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PLANNING COMMISSION DETERMINATION OF GENERAL
PLAN CONSISTENCY ON PROPERTY GENERALLY LOCATED
ON THE WEST SIDE OF CARLSBAD BOULEVARD BETWEEN
CHERRY AVENUE AND TAMARACK AVENUE
CASE NAME: CITY OF CARLSBAD
CASE NO: PCD 90-11
WHEREAS, a verified application for certain property to wit:
west side of Carlsbad Boulevard between Cherry Avenue and
Tamarack Avenue,
has been filed with the City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 17th day of July, 1991,
consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all
factors relating to the Planning Commission Determination; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission
as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission
APPROVES PCD 90-11, based on the following findings and subject to the
following conditions:

3. This project is exempt hm CEQA and a Notice of Exemption has been issued by
the Planning Director on October 14, 1990.
Conditions:
1. Approval is granted for PCD/GPC 90-1 1, as shown on Exhibit "A", dated
May 10, 1991, incorporated by reference and on file in the Planning Department.
11 Development shall occur substantially as shown unless otherwise noted in these
conditions.

2. Prior to the issuance of a grading permit, applicant shall obtain any required 13

Coastal Development Permit for approval of development which is in substantial
conformance with this City approval.
