PLANNING COMMISSION RESOLUTION NO. 3263
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING THE
EXTENSION OF A CONDITIONAL USE PERMIT TO ALLOW
THE COMMUNITY DEVELOPMENT FACILITY ON PROPERTY
GENERALLY LOCATED AT 2075 LAS PALMAS DRIVE.

ij I/ WHEREAS, a verified application has been filed with the City of Carlsbac

and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided b
9 II 11 Title 21 of the Carlsbad Municipal Code; and 10
11 WHEREAS, pursuant to the provisions of the Municipal Code, the Plannin

WHEREAS, at said public hearing, upon hearing and considering a
testimony and arguments, if any, of all persons desiring to be heard, said Commissic
20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissic
21 of the City of Carlsbad as follows:
22 A) That the foregoing recitations are true and correct.
23 B) That based on the evidence presented at the public hearing, the Commissic

FiIldinm:
1. That the requested use continues to be necessary or desirable for the developmenl
of the community, is essentially in harmony with the various elements anc
objectives of the general plan, and is not detrimental to existing uses or to use$
specifically permitted in the zone in which the proposed use is to be located;
2. That the site for the intended use continues to be adequate in size and shape tc
accommodate the use;
3. That all of the yards, setbacks, walls, fences, landscaping, and other feature!
necessary to adjust the requested use to existing or permitted future uses in thc
neighborhood have been provided and maintained;
4. That the street system serving the proposed use continues to be adequate tc
properly handle all traffic generated by the proposed use.
5. That the Planning Commission finds that there is no substantial adverse affect 01
surrounding land uses or the public’s health and welfare.
Conditions:
1. All conditions of approval imposed upon CUP 294 as stated in Plannin
Commission Resolution No. 2580 shall apply as conditions of approval for CU:
294x1 except Condition No. 6 is amended by Condition No. 2 below.
2, This conditional use permit is granted for a period of five years. This condition;
use permit shall be reviewed by the Planning Director on a yearly basis tl
determine if all conditions of this permit have been met and that the use does nc
have a significant detrimental impact on surrounding properties or the publi
health and welfare. If the Planning Director determines that the use has suc:
significant adverse impacts, the Planning Director shall recommend that th
Planning Commission, after providing the permittee the opportunity to be hearc
add additional conditions to mitigate the significant adverse impacts. This perm
may be revoked at any time after a public hearing, if it is found that the use hz
a significant detrimental affect on surrounding land uses and the public’s healt
and welfare, or the conditions imposed herein have not been met. This perm
may be extended for a reasonable period of time not to exceed five years up0
written application of the permittee made no less than 90 days prior to tk
expiration date. In granting such extension, the Planning Commission shall fin
that no substantial adverse affect on surrounding land uses or the public’s healt
and welfare will result because of the continuation of the permitted use. If
substantial adverse affect on surrounding land uses or the public’s health an
welfare is found, the extension shall be considered as an original application fc
a conditional use permit. There is no limit to the number of extensions tl
Planning Commission may grant.
