HomeMy WebLinkAbout1991-07-17; Planning Commission; Resolution 3272* /j 0 0 1 2 3 4 5 6 7 a 9 10 PLANNING COMMISSION RESOLUTION NO. 3272 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A SPECIAL USE PERMIT FOR A 32 LOT TENTATIVE TRACT MAP CONSISTING OF 29 RESIDENTIAL LOTS AND 3 OPEN SPACE LOTS ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF EL CAMINO REAL NORTH OF CAMINO HILLS DRIVE CASE NAME: EAGLE CANYON CASE NO: SUP 91-1 WHEREAS, a verified application for certain property, to wit: A portion of Lot F of Rancho Agua Hedionda according to Map No. 823, in the City of Carlsbad, County of San Diego, State of California, filed in the office of the County Recorder on November 16, 1896. 'I- /I has been filed with the City of Carlsbad, and referred to the Planning Commission; and 12 II 13 it WHEREAS, said application constitutes a request as provided by Title 21 oj 14 15 hold a duly noticed public hearing as prescribed by law to consider said request; and 16 WHEREAS, the Planning Commission did on the 17th day of July, 1991, 18 WHEREAS, at said public hearing, upon hearing and considering a1 17 testimony and arguments, if any, of all persons desiring to be heard, said CommissioI 19 considered all factors relating to the Special Use Permit; and the Carlsbad Municipal Code; and 2o I $1 I1 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio~ 22 A) That the foregoing recitations are true and correct. 23 of the City of Carlsbad as follows: 24 25 26 27 B) That based on the evidence presented at the public hearing, the Commissio: hereby recommends APPROVAL of SUP 91-1, based on the followin findings and subject to the following conditions: 28 - ll 0 0 1 2 3 4 5 6 7 8 9 20 11 12 13 14 FiIldiIlZS: 1. The project enhances the scenic qualities of the El Camino Real Corridor consisten with the corrido?s development standards by providing an attractive developmen which complies with the specified building heights, a minimum building setbacl of 70 feet along El Camino Real, and extensive landscaping which incorporates thl theme trees for the corridor. 2. The project protects scenic views and traffic safety along El Camino Real b: providing attractive buildings, performing corrective grading, extensivel; landscaping proposed slopes, making street improvements along the project? frontage, and taking access off of El Camino Real at an existing signalize( intersection. 3. The following findings of Section V of the El Camino Real Corridor Developmen Standards are made to allow cut or fill grading within the setback fiom El Camin( Red to exceed 10 feet fiom original grade: a) The limit of 10 feet of cut or fill is feasible given the grading required fo the widening of El Camino Real with or without the project. b) The use of setbacks, landscaping, and the creation of 2 to 1 slopes will nc compromise the scenic qualities of the corridor. The existing slope j barren, scoured and near vertical. 15 16 17 18 19 20 21 22 23 24 25 26 c) The proposed grading is necessary to accommodate the widening of circulation element road. All pertinent traffic standards will be met by th project including sight distance requirements and the deviation will nc have an adverse impact on traffic safety. d) The project as proposed has been designed to meet or exceed the &tent c the remaining E1 Camino Real Corridor Development standards. 4. The project is consistent with the City's General Plan since the proposed densit of 3.2 du's/acre is within the density range of 0-4 du's/acre specified for the sit as indicated on the Land Use Element of the General Plan, and is at or below th growth control point of 3.2. 5. The Planning Commission has, by inclusion of an appropriate condition to th project, ensured building permits will not be issued for the project unless the Cii Engineer determines that sewer service is available, and building cannot OCCI within the project unless sewer service remains available, and the Plannir Commission is satisfied that the requirements of the Public Facilities Element c the General Plan have been met insofar as they apply to sewer service for th project. 7. School fees will be paid to ensure the availability of school facilities in tl Carlsbad Unified School District. 8. Park-in-lieu fees are required as a condition of approval. 9. All necessary public improvements have been provided or will be required i conditions of approval. 10. The applicant has agreed and is required by the inclusion of an appropria condition to pay a public facilities fee. Performance of that contract and payme] of the fee will enable this body to find that public facilities will be availab concurrent with need as required by the General Plan. 11. The proposed project is compatible with the surrounding future land uses sinc surrounding properties are designated for residential development on the Gener Plan. 12. This project will not cause any si@cant environmental impacts and a Condition Negative Declaration has been issued by the Planning Director on January 3,199 and recommended for approval on July 17, 1991. In approving this Condition Negative Declaration the Planning Commission has considered the initial study, t€ staff analysis, all required mitigation measures and any written comments receivc regarding the significant effects this project could have on the environment. 13. The applicant is by condition, required to pay any increase in public facility fe or new construction tax, or development fees, and has agreed to abide by a1 additional requirements established by a Local Facilities Management Pk prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This w ensure continued availability of public facilities and will mitigate any curnulati' impacts created by the project. 14. This project is consistent with the City's Growth Management Ordinance as it h been conditioned to comply with any requirement approved as part of the Loc Facilities Management Plan for Zone 24. .... This project was subject to Chapter 21.95 of the Carlsbad Municipal Code (Hillsid1 Ordinance) and meets all the requirements of that Chapter to ensure the sensitiv treatment of the City's hillside resources. Conditions: 1. Approval is granted for SUP 91-1, as shown on Exhibit(s) "A" - "X", date July 17, 1991, incorporated by reference and on file in the Planning Departmen Development shall occur substantially as shown unless otherwise noted in thes conditions. 2. Approval of SUP 91-1 is granted subject to the approval of ZC 91-5, CT 914 HDP 91-2. 3.
