HomeMy WebLinkAbout1991-07-17; Planning Commission; Resolution 3278-2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e e PLANNING COMMISSION RESOLUTION NO. 3278 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A HILLSIDE DEVELOPMENT PERMIT ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF LUCIERNAGA STREET BETWEEN URUBU STREET AND CEBU PLACE. CASE NAME: LUCIERNAGA TOWNHOMES CASE NO: HDP 90-41 WHEREAS, a verified application for certain property to wit: La Costa Meadows, Lot 398, Unit 2, Map No. 6906, has been filed with the City of Carlsbad and referred to the Planning Commission; ant WHEREAS, said verified application constitutes a request as provided b Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 17th day of July, 1991 consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony an arguments, if any, of all persons desiring to be heard, said Commission considered a factors relating to the Planning Commission Determination; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissic as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissic APPROVES HDP 90-41, based on the following findings and subject to t following conditions: FiIldil-lES: 1. Hillside conditions have been properly identified. 2. The development proposal and all applicable development approvals and permits are consistent with the purpose, intent and requirements of the Hillside Development Regulations. 4. No development or grading will occur in those portions of the property which are undevelopable. 5. The project design and lot configuration minimize disturbance of hillside lands. 6. The project design substantially conforms to the intent of the concepts iUustratei in the development guidelines manual. Conditions: 1. All of the conditions included in CT 90-28, Resolution No. 3277, are hereb: included by reference. 2. Approval is granted for HDP 90-41, as shown on Exhibit "E", dated July 17 1991, incorporated by reference and on file in the Planning Department Development shall occur substantially as shown on the approved exhibits. Arq proposed grading and/or development substantially different from this approva as determined by the Planning Director, shall require an amendmnent to thi Hillside Development Permit. 3.
