HomeMy WebLinkAbout1991-07-17; Planning Commission; Resolution 3282I/ e 0 I/ PLANNING COMMISSION RESOLUTION NO. 3282 1 2 3 4 5 6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE LOCAL FACILITIES MANAGEMENT PLAN FOR ZONE 24 ON PROPERTY GENEWLY LOCATED ON THE WEST SIDE OF EL CAMINO REAL, NORTH OF CAMINO HILLS DRIVE. APPLICANT: EAGLE CANYON CASE NO: LOCAL FACILITIES MANAGEMENT PLAN - ZONE 24(A) WHEREAS, a verified application has been filed with the City of Carlsbad and referrec 7 to the Planning Commission, and 8 WHEREAS, the City Council passed Resolution No. 8797 adopting the 1986 Citywidc 9 Facilities and Improvements Plan establishing facility zones and performance standards fo lo public facilities, and 11 WHEREAS, the City Council adopted Ordinance No. 9808 requiring the processin1 12 13 ll of a Local Facilities Management Plan, and 14 15 16 Proposition E approved on November 4, 1986 by the citizens of Carlsbad, and noticed public hearing as prescribed by law to consider said request; and I" WHEREAS, the Planning Commission did, on the 17th day of July, 1991 , hold a duk WHEREAS, the City Council adopted Ordinance No. 8110 and 9829 implementinj l8 11 WHEREAS, at said public hearing, upon hearing and considering all testimony an( 19 I arguments, if any,, of all persons desiring to be heard, said Commission considered all factor relating to an amendment to the Open Space Exhibit as well as related text of the Locz 20 21 22 NOW, TH:EREFORE, BE IT HEREBY RESOLVED by the Planning Commission a 23 Facilities Management Plan for Zone 24. 24 follows: 25 26 27 28 A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissio recommends APPROVAL of the amendment to the Open Space exhibit and relate text for Local Facilities Management Plan - Zone 24, based on the following finding and subject to the following conditions: II 0 0 Findinns: 1 1. That the amendment to the open space exhibit and related text for the Local Facilities Management Plan for Zone 24 will not preclude the zone from meeting the Open 2 Space Performance Standard. 3 4 5 6 7 8 9 10 11 12 2. That the amendment to the Local Facilities Management Plan for Zone 24 is consistent vvith the Land Use Element, the Public Facilities Element, and the other Elements contained in Carlsbad's General Plan. 3. That the amendment to the Local Facilities Management Plan for Zone 24 is consistent with Section 21.90 of the Carlsbad Municipal Code (Growth Management), and with the adopted Citywide Facilities and Improvements Plan 4. This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Planning Director on January 3, 1991. Conditions: 1.
