A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DENYING A SITE
DEVELOPMENT PLAN AMENDMENT NO. SDP 83-ll(C) TO
ALLOW A Dm-THRU SERVICE AT A McDONALD'S
RESTAURANT ON PROPERTYGENERALLY LOCATED AT 5990
AVENIDA ENCINAS.
CASE NO: SDP 83-11 (C)
WHEREAS, a verified application has been filed with the City of Carlsbad and
CASE NAME: McDONALD'S DRIVE-THRU
referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by Title
21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
Commission did, on the 21st day of August, 1991, consider said request on property
described as:
That portion of Lot "H" of Rancho Agua Hedionda, according
to Map 823, filed November 16,1896, in the City of Carlsbad,
County of San Diego, State of California.
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Commission considered all
factors relating to SDP 83-11 (C).
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission
of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission
DENIES SDP 83-1 1 (C), based on the following findings:

FINDINGS:
1. The requested use is not properly related to the site, surroundings, or environmentz
settings as it aggravates the observed poor circulation within the parking lot an
increases the possibility of queuing of automobiles onto Avenida hcinas. Tht
request is not consistent with the various elements of the General Plan because i
facilities since it inhibits the adjacent restaurant's existing loading zone by directin1
traffic through the loading area. The request is also detrimental to existing uses am adversely impacts the site, surroundings, and traffic circulation as it is not certai
to be compatible with the adjacent restaurant's loading zone or the current parkin4
lot circulation.

The site, at times, barely accommodates the traffic circulation and parking for thf
existing uses. Addition of a drive-thru facility without major site redesign woulc
increase existing onsite circulation problems and, therefore, the site is not adequatt
in size and shape to accommodate the use.
As stated previously, the existing circulation pattern and parking lot layout woulc
have to be significantly modified to accommodate the drive-thru aisle.
Consequently, the yards, setbacks, walls, fences, landscaping, and other features
are not being provided. necessary to adjust the requested use to existing or future uses in the neighborhood

15 generated by the proposed use as Avenida F.ncinas is a secondary arterial.
4. The street system serving the property is adequate to properly handle all trafXc
