CONDITIONAL USE PERMIT TO ALLOW A DRIVE-THRU CASE NAME: McDONALD'S DRIVE-THRU CASE NO: CUP 91-5 7 WHEREAS, a verified application has been filed with the City of Carlsbad 8 and referred to the Planning Commission; and 9 WHEREAS, said verified application constitutes a request as provided by lo I/ Title 21 of the Carlsbad Municipal Code; and 11 12 13 14 consider said application on property described as: WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did, on the 21st day of August, 1991, hold a duly noticed public hearing to 15 16 That portion of Lot "H" of Rancho Agua Hedionda according to Map 823, filed November 17, 1896, in the City of Carlsbad, County of San Diego, State of California. I? /I WHEREAS, at said public hearing, upon hearing and considering all 18 19 testimony and arguments, if any, of all persons desiring to be heard, said Commission // considered all factors relating to CUP 91-5. 20 21 22 A) That the foregoing recitations are true and correct. 23 of the City of Carlsbad as follows: NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission 24 25 B) That based on the evidence presented at the public hearing, the Commission DENIES CUP 91-5, based on the following findings: 26 27 ..... 28 I1 0 0 1 2 3 4 5 6 7 FINDINGS: 1. The requested use is not properly related to the site, surroundings, 01 environmental settings as it aggravates the observed poor circulation within thc parking lot and increases the possibility of queuing of automobiles onto Avenik bcinas. The request is not consistent with the various elements of the Genera' Plan because it neither improves the existing circulation situation nor guarantee! sufficient loading facilities since it inhibits the adjacent restaurant's existin8 loading zone by &ec&g &c through the loading area. The request is alsc detrimental to existing uses and adversely impacts the site, surroundings, ani traffic circulation as it is not certain to be compatible with the adjacen restaurant's loading zone or the current parking lot circulation. ~ 8 9 2. 10 11 3. 12 13 The site, at times, barely accommodates the traffic circulation and parking for thf existing uses. Addition of a drive-thru facility without major site redesign woulc increase existing onsite circulation problems and, therefore, the site is no adequate in size and shape to accommodate the use. As stated previously, the existing circulation pattern and parking lot layout woulr have to be significantly modified to accommodate the drive-thru aisle Consequently, the yards, setbacks, walls, fences, landscaping, and other feature: necessary to adjust the requested use to existing or future uses in tht neighborhood are not being provided. 14 15 16 17 18 19 20 21 22 23 4. That the street system serving the property is adequate to properly handle a1 traffic generated by the proposed use as Avenida Encinas is a secondary arteria with existing traffic volumes well below capacity. ..... ..... ..... ..... .....
