CASE NAME: PAY N PLAY RACQUETBALL CASE NO: PIP 86-2(A) 7 8 referred to the Planning Commission; and WHEREAS, a verified application has been filed with the City of Carlsbad anc 9 WHEREAS, said verified application constitutes a request as provided by Thlt lo 11 21 of the Carlsbad Municipal Code; and 11 12 WHEREAS, pursuant to the provisions of the Municipal Code, the Planning 13 14 Commission did, on the 21st day of August, 1991, consider said request on propeq described as: 15 16 Lots 10 - 13 of Carlsbad Tract No. 74-21, in the City of Carlsbad, County of San Diego, State of California. lr II WHEREAS, at said public hearing, upon hearing and considering all testimony 18 factors relating to PIP 86-2(A). 19 and arguments, if any, of all persons desiring to be heard, said CO~S~O~ considered all 2o I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission 21 11 of the City of Carlsbad as follows: 22 23 24 25 A) That the foregoing recitations are true and correct. The improvements indicated on the Planned Industrial Permit Amendment arc located in such a manner to be related to existing and proposed streets and highways as they are interior improvements within an existing, conformin2 industrial development. 2. The improvements as shown on the Planned Industrial Permit Amendment art consistent with the intent and purpose of the P-M zone and all adoptec development, design, and performance standards as set forth by Chapter 21.34 o the Carlsbad Municipal Code because it provides for needed active recreation are: in the area without requiring a modification to an existing, conformini development. a 9 Conditions: lo 1. Approval is granted for PIP 86-2(A), as shown on Exhibit(s) "A" - "M", dated Development shall occur substantially as shown unless otherwise noted in thesc 11 August 21,1991, incorporated by reference and on file in the Planning Department 12 14 2. Approval of PIP 86-2(A) is granted subject to the approval of CUP 91-1. I.3 conditions. PIP 86-2(A) is subject to all conditions of CUP 91-1 as contained in Planniq 15 the Planning Department. Prior to the issuance of the building permit there shall be a deed restriction placec on the deed to this property subject to the satisfaction of the Planning Direct01 notifying all interested parties and successors in interest that the City of Carlsbac has issued a Planned Industrial Permit by Resolution No. 3287 on the real propertj owned by the declarant. Said deed restriction shall note the property description location of the file containing complete project details and all conditions of approva as well as any conditions or restrictions specified for inclusion in the deec restriction. Said deed restriction(s) may be modified or terminated only with thc approval of the Planning Director, Planning Commission or City Council of the Ciq of Carlsbad whichever has final decision authority for this project.
