CASE NAME: JAMES E. VINE CHANGE FROM R-1-7500 TO RD-M ON PROPERTY LOCATED AT 295 CASE NO: ZC 91-2 WHEREAS, a verified application for certain property, to wit: The southwesterly 123 feet of Lot 6, in Block "T" of Palisades #2, in the City of Carlsbad, County of San Diego, State of California, excepting therefrom the southwesterly 63 feet thereof, according to the Map thereof No. 1803 filed in the Office of the County Recorder of San Diego County, August 25, 1924. has been filed with the City of Carlsbad, and referred to the Planning Commission; an( WHEREAS, said application constitutes a request as provided by Title 21 of thc Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 4th day of September, 1991, holc a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony anc arguments, if any, of all persons desiring to be heard, said Commission considered al: factors relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. That approval of the Zone Change would be premature pending an area wide study for a General Plan Amendment and Zone Change. 2. That the requested Zone Change is inconsistent with the Council direction tc maintain the general area south of Chinquapin Avenue and west of the AT&SE Railroad as R-1 as accepted in the North Beach Pla.nning/Traffic Study. 3. That approval of the requested Zone Change will encourage developmen incompatible with the existing land uses. 4. That the existing streets are in violation of the City of Carlsbad cul-de-sac policy 5. That an increase in development potential for the area south of Tamarack Avenut and west of the Santa Fe Railroad will be detrimental to the health, safety an( welfare of the residents of that area.
