A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE
GENERALLY LOCATED AT 237 DATE AVENUE
CASE NAME: 237 DATE AVENUE
DEVELOPMENT PLAN NO. SDP 91-9 ON PROPERTY
CASE NO: SDP 91-9
WHEREAS, a verified application has been filed with the City of Carlsbad and
6 referred to the Planning Commission; and
7 WHEREAS, said verified application constitutes a request as provided by Titlc
8 21 of the Carlsbad Municipal Code; and

WHEREAS, pursuant to the provisions of the Municipal Code, the Plannini
Commission did, on the 16th day of October, 1991, consider said request on propert]

California according to map No. 1803, filed in the office of the.
County Recorder of San Diego County, California on August

and arguments, if any, of all persons desiring to be heard, said Commission considered a1

20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio:

A) That the foregoing recitations are true and correct. 22

B) That based on the evidence presented at the public hearing, the Commissio
24 APPROVES SDP 91-9, based on the following findings and subject to the followin
conditions:

Findinns:
1. That the proposed buildings relate to the site, surroundings and environment^
setting, are consistent with the various elements of the General Plan, will not lx
detrimental to existing or permitted uses and will not adversely impact the site,
sun-oun&gs or traffic circulation.
2. That the site for the intended use is adequate in size and shape to accommodate tht
use.
3. That all of the yards, setbacks, walls, fences, landscaping, and other feature!
necessary to adjust the requested use to existing or permitted future uses in tht
neighborhood will be provided and maintained.
4. That the street system serving the proposed use is adequate to properly handle al
traffic generated by the proposal.
Conditions:
1. Approval is granted for SDP 91-9, as shown on Exhibit(s) "A" - "D", dated Octobe:
16, 1991, incorporated by reference and on file in the Planning Department
Development shall occur substantially as shown unless otherwise noted in thesc
conditions.
2. The applicant shall provide school fees to mitigate conditions of overcrowding a
part of building permit application. These fees shall be based on the fee schedulc
in effect at the time of building permit application.
16 3. Water shall be provided to this project pursuant to the Water Service agreemen
between the City of Carlsbad and the Carlsbad Municipal Water District, dated Ma;

18 4. This project shall comply with all conditions and mitigation required by the Zonl
19 1 Local Facilities Management Plan approved by the City Council on September 1
1987, incorporated herein and on file in the Planning Department and any futur
20 amendments to the Plan made prior to the issuance of building permits.

7. The developer shall install street trees at the equivalent of 40-foot intervals aloni
all public street frontages in conformance with City of Carlsbad standards, Tht
trees shall be of a variety selected from the approved Street Tree List.
8. Landscape plans shall be designed to minimize water use. Lawn and other zone I
plants (see Landscape Manual) shall be limited to areas of special visual importancc
or high use. Mulches shall be used and irrigation equipment and design shal
promote water conservation.
9. Building identification and/or addresses shall be placed on all new and existinl
buildings so as to be plainly visible from the street or access road; color o
identification and/or addresses shall contrast to their background color.
10. As part of the plans submitted for building permit plan check, the applicant shal
include a reduced version of the approving resolution/resolutions on a 24" x 36'
blueline drawing. Said blueline drawing(s) shall also include a copy of an: applicable Coastal Development Permit and signed approved site plan.
