A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT TO ALLOW THE CONVERSION
ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE
OF HARDING AVENUE BETWEEN CHESTNUT AVENUE AND
PALM AVENUE.
CASE NAME: CENTRO DE INFORMACION
OF A SINGLE FAMILY RESIDENCE TO A WALK-IN LIBRARY
CASE NO: CUP 91-11
WHEREAS, a verified application has been filed with the City of Carlsbac
8 and referred to the Planning Commission; and
9 WHEREAS, said verified application constitutes a request as provided b:
10 Title 21 of the Carlsbad Municipal Code; and
11 WHEREAS, pursuant to the provisions of the Municipal Code, the Planninj

WHEREAS, at said public hearing, upon hearing and considering a1
18 11 testimony and arguments, if any, of all persons desiring to be heard, said CommissioI

Findings:
1. That the requested use is necessary or desirable for the development of the
community because it provides a needed service to the Hispanic community, is
essentially in harmony with the various elements and objectives of the general plan
since it maintains an orderly balance of public uses in a convenient and compatible
location, and is not detrimental to existing uses or to uses specifically permitted
in the zone in which the proposed use is to be located as the hours of operation
are coincident with the normal working hours of neighboring residents and all
functions will be conducted inside the structure.
2. That the site for the intended use is adequate in size and shape to accommodate
the use as evidenced by the lack of any improvements to the site or structure and
the ample amount of on street parking in the area.
3. That all of the yards, setbacks, walls, fences, landscaping, and other feature:
necessary to adjust the requested use to existing or perrnitted future uses in thf
neighborhood will be provided and maintained since the existing setbacks, fences
and landscaping are sufficient to ensure compatibility of the use and signage wil:
be kept to the minimum needed for identification of the center.
4. That the street system serving the proposed use is adequate to properly handle a1
traffic generated by the proposed use, since the information center will no
produce any more traffic than a typical single family residence and Harding Stree'
currently operates efficiently as a local street.
Conditions:
1. Approval is granted for CUP 91-11, as shown on Exhibit "A", date1
October 16, 1991, incorporated by reference and on file in the Plannin,
Department. Development shall occur substantially as shown unless otherwis
noted in these conditions.
2. Approval of this request shall not excuse compliance with all sections of th
Zoning Ordinance and all other applicable City ordinances in effect at time c
building permit issuance.

This conditional use permit is granted for a period of one (I) year. ~hl conditional use permit shall be reviewed by the Planning Director on a semi-annu:
basis to determine if all conditions of this permit have been met and that the us
does not have a significant detrimental impact on surrounding properties or th
public health and welfare. If the Planning Director determines that the use h
such significant adverse impacts, the Planning Director shall recommend that th
Planning Commission, after providing the permittee the opportunity to be hearc
add additional conditions to mitigate the significant adverse impacts. This perm
may be revoked at any time after a public hearing, if it is found that the use hb
a significant detrimental affect on surrounding land uses and the public’s healtl
and welfare, or the conditions imposed herein have not been met. This permi
may be extended for a reasonable period of time not to exceed one (1) year up01
written application of the permittee made no less than 90 days prior to th’
expiration date. In granting such extension, the Planning Commission shall fin,
that no substantial adverse affect on surrounding land uses or the public’s healtj
and welfare will result because of the continuation of the permitted use. rf

welfare is found, the extension shall be considered as an original application fo
a conditional use permit. There is no limit to the number of extensions th
Planning Commission may grant.
All landscaped areas shall be maintained in a healthy and thriving condition, fief
from weeds, trash, and debris.
Any signs proposed for this development shall at a minimum be designed ir
conformance with the City‘s Sign Ordinance and shall require review and approva
of the Planning Director prior to installation of such signs.
