CASE NAME: LEUCADIA COUNTY WATER DISTRICT CASE NO: CUP 130(A) WHEREAS, a verified application has been filed with the City of Carlsbac 8 and referred to the Planning Commission; and 9 WHEREAS, said verified application constitutes a request as provided b: lo )I Title 21 of the Carlsbad Municipal Code; and XI. I( WHEREAS, pursuant to the provisions of the Municipal Code, the Planninl 12 13 Commission did, on the 20th day of November, 1991, hold a duly noticed public hearin4 14 I/ to consider said application on property described as: 15 16 A portion of Lot 9 in Section 35, Township 12 South, Range 4 West, San Bernardino Base and Meridian in the County of San Diego, State of California. The requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the general plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. 2. The site for the intended use is adequate in size and shape to accommodate thc use. 3. All of the yards, setbacks, walls, fences, landscaping, and other features necessaq to adjust the requested use to existing or permitted future uses in tht neighborhood will be provided and maintained. 4. The street system serving the proposed use is adequate to properly handle al traffic generated by the proposed use. 5. The Planning Commission has, by inclusion of an appropriate condition to thi: project, ensured building permits will not be issued for the project unless the Ciq Engineer determines that sewer service is available, and building cannot occu: within the project unless sewer service remains available, and the Plannini Commission is satisfied that the requirements of the Public Facilities Element o the General Plan have been met insofar as they apply to sewer service for thi project. 6. All necessary public improvements have been provided or will be required a, conditions of approval. 7. The proposed project is compatible with the surrounding future land uses sincl surrounding properties are designated for commercial development on the Genera Plan. 8. This project is consistent with the City's Growth Management Ordinance as it ha been conditioned to comply with any requirement approved as part of the LOG Facilities Management Plan for Zone 6. 9. Approval is granted for Cup 130(A), as shown on Exhibit(s) "A" - "I", dated October 15, 1991, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. The developer shall provide the City with a reproducible 24" x 36", mylar copy ol the Site Plan as approved by the Planning Commission. The Site Plan shall reflecl the conditions of approval by the City. The Plan copy shall be submitted to thc City Engineer prior to issuance of building permits or improvement plan submittal, whichever occurs first. 3. The conditions imposed for CUP 130 shall be superseded by those imposed fo~ CUP 130 (A). 4. This project is approved upon the express condition that building permits will no be issued for development of the subject property unless the City Engineel determines that sewer facilities are available at the time of application for suc€ sewer permits and will continue to be available until time of occupancy. 5. Water shall be provided to this project pursuant to the Water Service agreemen between the City of Carlsbad and the Carlsbad Municipal Water District, dated Ma; 25, 1983. 15 6. This project shall comply with all conditions and mitigation required by the Zonc 1987, incorporated herein and on file in the Planning Department and any futurc 16 6 Local Facilities Management Plan approved by rhe City Council on November 10 1'1 amendments to the Plan made prior to the issuance of building permits. 18 19 20 21 7. If any condition for construction of any public improvements or facilities, or thl papent of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided il Government Code Section 65913.5. If any such condition is determined to b invalid this approval shall be invalid unless the City Council determines that th project without the condition complies with all requirements of law. 22 8. Approval of this request shall not excuse compliance with all sections of th Zoning Ordinance and all other applicable City ordinances in effect at time c 23 building permit issuance. 24 9. All roof appurtenances, including air conditioners, shall be architecturallq integrated and concealed from view and the sound buffered from adjacen properties and streets, in substance as provided in Building Department Policy No 80-6, to the satisfaction of the Directors of Planning and Building. 11, No outdoor storage of material shall occur onsite unless required by the Fire Chief In such instance a storage plan will be submitted for approval by the Fire Chie and the Planning Director. 12. The applicant shall prepare a detailed landscape and irrigation plan which shall bc submitted to and approved by the Planning Director prior to the issuance o grading or building permits, whichever occurs first. 13. All landscaped areas shall be maintained in a healthy and thriving condition, frec from weeds, trash, and debris. 14, All landscape plans shall be prepared to conform with the Landscape Manual an( submitted per the landscape plan check procedures on file in the Plannini Department. 15. Landscape plans shall be designed to minimize water use. Lawn and other zonc 1 plants (see Landscape Manual) shall be limited to areas of special visua importance or high use. Mulches shall be used and irrigation equipment an( design shall promote water conservation. 16. Prior to final occupancy, a letter from a California licensed landscape architec shall be submitted to the Planning Director certifying that all landscaping has bee] installed as shown on the approved landscape plans. 17. All herbicides shall be applied by applicators licensed by the State of California, 18. The applicant shall pay a landscape plan check and inspection fee as required b Section 20.08.050 of the Carlsbad Municipal Code. This fee may be waived at th discretion of the Planning Director. 19. The first set of landscape and irrigation plans submitted shall include buildin plans, improvement plans and grading plans. 20. The minimum shrub size shall be 5 gallons. 21. 30% of trees in industrial and commercial projects shall be 24" box or greater. 22. Any signs proposed for this development shall at a minimum be designed in conformance with the City‘s Sign Ordinance and shall require review and approval of the Planning Director pdor to ktallation of such signs. 24. As part of the plans submitted for building permit plan check, the applicant shall include a reduced version of the approving resolution/resolutions on a 24” x 36’ blueline drawing. Said blueline drawing(s) shall also include a copy of anj applicable Coastal Development Permit and signed approved site plan. Fire: 25. Prior to the issuance of building permits, complete building plans shall bt submitted to and approved by the Fire Department. 26. Applicant shall submit a site plan to the Fire Department for approval, whicl depicts location of required, proposed and existing public water mains and firt hydrants. The plan should include off-site fire hydrants within 200 feet of tht project. 27. An all weather, unobstructed access road suitable for emergency service vehicle! shall be provided and maintained during construction. When in the opinion of tht Fire Chief, the access road has become unserviceable due to inclement weather 01 other reasons, he may, in the interest of public safety, require that constructio~ operations cease until the condition is corrected. 28. AU security gate systems controlling vehicular access shall be equipped with I “Knox”, key-operated emergency entry device.
