PLANNING COMMISSION RESOLUTION NO. 3315
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO
OPERATE A CERTIFIED FARMER’S MARKET ON PROPERTY GENERALLY
LOCATED AT 5600 AVENIDA ENCINAS.
CASE NAME: FLORAL TRADE CERTIFIED FARMER’S MARKET
CASE NO: CUP 91-8
WHEREAS, a verified application has been filed with the City of Carlsbad an
referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by Title 2
of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Plannir
Commission did, on the 20th day of November, 1991, and on the 4th day of Decembe
1991, hold a duly noticed public hearing to consider said application on propell
described as:
Parcel 1 of Parcel Map No. 14009, in the City of Carlsbad, County of San
Diego, State of California, according to the Map thereof filed in the Office
of the County Recorder of San Diego County, on November 1, 1985.
WHEREAS, at said public hearing, upon hearing and considering all testimony an

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission oft€

FindinnS:
1. That the requested use is a desirable use for the community in that it suppor
policy of the Local Coastal Program to establish a farm cooperative, is essentiall
not detrimental to existing uses or to uses specifically permitted in the PM zon
2. That the site for the intended use is adequate in size and shape to accommoda
the use because there is more parking available onsite than is necessary and tha
is ample area available for vehicular circulation.

Conditions:
1. Approval is granted for CUP 91 -8, as shown on Exhibits "A"-"Ct, dated Novembl
20, 1991, incorporated by reference and on file in the Planning Departmen

and the public's health and welfare, or the conditions imposed herein have nc
been met.
4. If the property owner/owners' address changes from that which is shown on th
conditional use permit application, a notice of a change of address shall E
reported, in writing, to the Planning Department within 30 days.

5. A single portable "monument" sign shall be allowed to be placed at the entranc
to the site during operating hours of the her's market. Design and location t
the sign shall be approved by the Planning Director through a Sign Permit.

6. This approval is specifically for the operation of a maximum of 35 farmer's stal
during the hours of 1:oO PM to 4:oO PM on Saturdays only. Any change to t€
number of stalls or hours of operation shall require approval of the Plannir
Commission.
7. The applicant shall submit a site plan to the Fire Department for approval (
access, driveways, and general traffic circulation.
13 8. Circulation aisles shall be kept clear of parked vehicles at all times, and shall haT
