A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT ALLOWING THE PILGRIM
CONGREGATIONAL CHURCH AND AN EXPANSION TO
INCLUDE AN ADJACENT SINGLE FAMILY RESIDENCE TO
BE USED FOR SUNDAY SCHOOL CLASSROOMS AND ADULT
MEETING ROOMS ON PROPERTY GENERALLY LOCATED AT
2020 AND 2030 CHESTNUT AVENUE.

7 WHEREAS, a verified application has been filed with the City of Carlsbac
8 and referred to the Planning Commission; and

WHEREAS, said verified application constitutes a request as provided bs
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Planninl
Commission did, on the 5th day of February, 1992, hold a duly noticed public hearing tc
14 consider said application on property described as:

WHEREAS, at said public hearing, upon hearing and considering a]

18 testimony and arguments, if any, of all persons desiring to be heard, said Commissiol

20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio

Findinns:
1. That the requested use is necessary and desirable for the development of t
communityy is essentially in harmony with the General Plan, and is not detrjxnen
to existing US@ or to uses specifically permitted in the zone in which the pmpos
use is to be located since use of the facility requires no new construction or s
alteration, regular use is limited to Sundays and weekly evening meetings and
annual temporary homeless shelter, and existing onsite parking is provided.
2. That the site for the intended use is adequate in size and shape to accommok
the use; since an existing residence will be utilized and all yards, setbacks, wal
fences, landscaping, and other features necessary to adjust the requested use
existing or permitted future uses in the neighborhood are currently provided a:
maintained;
3. That the street system serving the proposed use is adequate to properly handle
existing traffic and the proposed use will not generate additional traffic.
Conditions:
1. Approval is granted for CUP 85(B), as shown on Exhibit "A", dated February
1992, incorporated by reference and on file in the Planning Departmer
Development shall occur substantially as shown unless otherwise noted in the
conditions.
2. This conditional use permit is granted for a period of 5 years commencing c
February 5, 1992. This conditional use permit shall be reviewed by the Plannir
Director on a yearly basis to determine if all conditions of this permit have be€
met and that the use does not have a significant detrimental impact c
surrounding properties or the public health and welfare. If the Planning Directc
determines that the use has such significant adverse impacts, the Planning Directc
shall recommend that the Planning Commission, after providing the permittee tl
opportunity to be heard, add additional conditions to mitigate the significa
adverse impacts. This permit may be revoked at any time after a public hearin
uses and the public's health and welfare, or the conditions imposed herein haT
not been met. This permit may be extended for a reasonable period of time nc
to exceed 5 years upon written application of the permittee made no less than S
days prior to the expiration date. In granting such extension, the Plannir
Commission shall find that no substantial adverse affect on surrounding land us(
or the public's health and welfare will result because of the continuation of ti
permitted use. If a substantial adverse affect on surrounding land uses or tl
public's health and welfare is found, the extension shall be considered as 2
original application for a conditional use permit. There is no limit to the numb,
of extensions the Planning Commission may grant.

3. This approval is subject to all conditions of Planning Commission Resolutions 349,
918, and 1640 except that Condition No. 3 of Resolution No. 918 is superseded
by Condition No. 2 above, and Condition No. 4 of Resolution No. 349 is deleted.
4. No exterior wall signs shall be permitted on any elevation of the meeting mom
facility at 2030 Chestnut Avenue.
5. Parking shall be prohibited in the driveway of the proposed meeting room faciliq
at 2030 Chestnut Avenue. The applicant shall post architecturally compatible 12
1' wooden "NO PARKING" signs not to exceed 42" in height at the front pro pert^
line on each side of the driveway within 30 days of this approval.
6. Regular weekly use of the meeting room facility at 2030 chestnut Avenue shall bf
limited to Sunday School classes which do not exceed 4 hours in any one day 01
12 hours in any one week with attendance not to exceed 50 students during tht
two worship services, a Sunday evening adult forum, weekly adult evenin$
meetings, and an annual homeless shelter providing assistance to not more tha~
12 people for a period not to exceed 30 days and conducted as specified in Exhibi
'X' attached hereto and incorporated herein by reference.
Water Conditions:
7. New sewer and water fees for this new use shall be paid prior to Pilgrim Churcl
occupancy.
Fire Conditions:
8. Structure shall meet requirements of the UBC for the intended use prior tc
occupancy.

PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 5th day of February, 1992
by the following vote, to wit:
