HomeMy WebLinkAbout1992-02-19; Planning Commission; Resolution 33321 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 l? 18 19 20 21 22 23 24 25 26 27 28 e 0 PLANNING COMMISSION RESOLUTION NO. 3332 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SPECIAL USE PERMIT TO ALLOW THE RECONSTRUCTION AND REPAIR OF APPROXIMATELY 1,000 FEET OF AN EXISTING GRANITE RIPRAP REVETMENT AND DIRT ACCESS ROAD ON PROPERTY GENERALLY LOCATED ALONG THE NORTH AND NORTHEAST SHORELINE OF THE OUTER AGUA HEDIONDA LAGOON. CASE NAME: SDG&E RIPRAP RECONSTRUCTION CASE NO: SUP 91-6 WHEREAS, a verified application for certain property, to wit: Map 1803 - Palisades No. 2 - Block W in the City of carlsbad, County of San Diego according to map no. 1803 filed in the office of the County Recorder August 25, 1924. has been filed with the City of Carlsbad, and referred to the Planning Commission; anc WHEREAS, said application constitutes a request as provided by Title 21 0: the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 19th day of February 1992, hold a duly noticed public hearing as prescribed by law to consider said request and WHEREAS, at said public hearing, upon hearing and considering d testimony and arguments, if any, of all persons desiring to be heard, said Commissio: considered all factors relating to the Special Use Permit; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. The project is consistent with the City's General Plan because it provides erosion protection for the Agua Hedionda shoreline and the surrounding coastal bluffs. 2. The project would not adversely affect or unduly hinder, restrict or alter the water carrying function of the flood plain or adversely affect surrounding development. 3. The project will not adversely or significantly impact the environment. The area adjacent to the existing revetment has been disturbed and the project would not impact eel grass habitats located further to the south. 4. All permit requirements of Chapter 21.1 10 of the Carlsbad Municipal Code have been satisfied. Conditions: 1. Approval is granted for SUP 90-12, as shown on Exhibit(s) "A" - "E", datec February 19, 1992, incorporated by reference and on file in the P1anni.n~ Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. Prior to approval of any grading or building permits for this project, a Coasta Development Permit shall be obtained from the California Coastal Commissior Said permit shall be in conformance with SUP 91-6. 3. Prior to approval of any grading or building permits for this project, a 404 Pd shall be obtained form the United States Army Corps of Engineers, if required b the Corps of Engineers. 4. Prior to approval of any grading or building permits for this project, and : required by the State, a permit shall be obtained from the California Departma of Fish and Game. ... ... ... ... ... ...
