HomeMy WebLinkAbout1992-02-19; Planning Commission; Resolution 3349" 1 2 3 4 5 6 0 0 PLANNING COMMISSION RESOLUTION NO. 3349 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN FROM RL AND RLM TO OS AND RLM ON PROPERTY GENERALLY LOCATED ON THE SOUTHWESTERLY SIDE OF EL CAMINO REAL BETWEEN THE FUTURE EXTENSION OF CANNON ROAD AND EXISTING CAMINO HILLS DRIVE CASE NAME: EVANS POINT CASE NO: GPA 91-3 7 WHEREAS, a verified application for an amendment to the General Plan 8 9 designation for certain property located, as shown on Exhibit GPA 91-3, dated February 10 19, 1992, attached and incorporated herein, has been filed with the Planning 11 I) Commission; and 12 Ii WHEREAS, said verified application constitutes a request for amendmen1 13 14 as provided in Title 21 of the Carlsbad Municipal Code; and 16 1992, hold a duly noticed public hearing as prescribed by law to consider said request; l5 WHEREAS, the Planning Commission did, on the 19th day of February: WHEREAS, at said public hearing, upon hearing and considering all 17 testimony and arguments, if any, of all persons desiring to be heard, said Commissior 18 19 I1 considered all factors relating to the General Plan Amendment. 20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissior 21 A) That the above recitations are true and correct. 22 of the City of Carlsbad, as follows: recommends APPROVAL of GPA 91-3, as shown on Exhibit GPA 91-: 24 23 attached hereto, based on the following findings and subject to thc B) That based on the evidence presented at the public hearing, the CommissioI 25 following conditions. 26 27 ... ... 28 .' Goal "A" of the General Plan Land Use Element is to preserve and enhance the environment, character and image of the City as a desirable residential, beach and open-space oriented community. The proposed designations accomplish this by designating the areas of the site containing significant habitat as open space to ensure their preservation and conservation which also results in the creation of desirable residential areas adjacent to the open space areas. 6 7 2. €3 9 10 11 3. The proposed amendment complies with Goal "H" of the Land Use Element of encouraging development only in those areas which can best support a change in land use without impact as the areas of the site not suitable for development as well as contiguous developable areas will be preserved in open space to create a viable open space system on and off site. The proposed land use change is appropriate as necessary services are currently provided to the site as required by Land Use Element Policy "A" and additional associated tentative map. improvements necessary for the proposed land use have been required of the 12 13 14 15 16 17 18 19 20 21 22 23 24 25 4. Policy 'B" of the Land Use Elernent is also complied with as the locations of the proposed land use designations in conjunction with the project design will resull in a functionally efficient street system and an aesthetically pleasing site as a resuzf of the preservation of a major portion of the site as open space. 5. The proposed amendment complies with Goals kl, k3, and A5 in addition tc Policies C.1, C.5, and C.6 of the Open Space and Conservation Element by designating 59.4 acres (46%) of the site as open space. Riparian habitat as well as chaparral habitat is being preserved in its natural condition and a 100 fool buffer is provided adjacent to the riparian area. 6. Uses which would be permitted by the proposed General Plan designations will bc compatible with existing and allowable future land uses. Conditions: 1. All conditions of EIR 91-2, as contained in Resolution No. 3348, and LCPA 91-1 ZC 91-6, (X 91-3, HDP 91-3, and SUP 91-2 are incorporated herein by reference Refer to those documents for all conditions and mitigation measures applicable t( the development of the Evans Point project site. 2. Approval of GPA 91-3 is granted subject to the approval of EIR 91-2, LCPA 91-1 and ZC 91-6. 26 /I 3.
