CASE NAME: EVANS POINT CASE NO: ZC 91-6 WHEREAS, a verified application for certain property, to wit: A portion of Lot "F" of Rancho Agua Hedionda, in the County of San Diego, State of California, according to the map thereof no. 823, filed in the office of the County Recorder of San Diego County, November 16, 1896, has been filed with the City of Carlsbad, and referred to the Pladng Codss;on; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 19th day of February, 1992, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. €3) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZC 91-6, according to "Exhibit X" attached hereto, based on the following findings and subject to the following conditions. ... . ,. 0 0 1 2 3 4 5 Findings: 1. The proposed change in zoning designations from L-C to R-1 and OS is consisteni with the proposed RLM and OS General Plan designations. 2. The single family residential uses allowed by the proposed Zone Change to R-1 would be compatible with surrounding existing or proposed residential, oper space, and non-residential uses. 6 3. The proposed rezoning of slopes of 25 percent and greater with mixed chaparral: the riparian area, and the riparian buffer to Open Space will serve to ensure thc 7 preservation of these areas as open space. 8 9 10 11 12 13 14 15 16 17 18 19 4. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 21 OP THE CARLSBAD MUNICIPAL CODE BY AN AMENDMENT TO THE ZONING MAP TO GRANT A ZONE CHANGE, ZC 91-6 FROM LC to R-1 AND OS ON PROPERTY GENERALLY LOCATED ON THE SOUTHWESTERLY SIDE OF EL CAMINO REAL BETWEEN THE FUTURE EXTENSION OF CANNON ROAD AND EXISTING CAMINO HILLS DRIVE. CASE NAME: EVANS POINT CASE NO.: ZC 91-6 The City Council of the City of Carlsbad, California does ordain as follows: SECTION I: That Title 21 of the Carlsbad Municipal Cod€ is amended by the amendment of a zoning map as shown on the may marked "Exhibit ZC 91-6" attached hereto and made a part hereof. SECTION 11: That the findings and conditions of thc Planning Commission as set forth in Planning Commission Resolutior 3351 constitutes the findings and conditions of the City Council. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certifq to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
