The site is physically suitable for the type and density of the development since the site is adequate in size and shape to accommodate residential development at the density proposed. 5. The Planning Commission has, by inclusion of an appropriate condition to thi: project, ensured building permits will not be issued for the project unless the Ciq Engineer determines that sewer service is available, and building cannot OCCUI within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the Public Facilities Element of thc General Plan have been met insofar as they apply to sewer service for this project 6. School fees will be paid to ensure the availability of school facilities in the Carlsbac School District. 7. Park-in-lieu fees are required as a condition of approval. 8. All necessary public improvements have been provided or will be required a conditions of approval. 22 9. The applicant has agreed and is required by the inclusion of an appropriatl 23 condition to pay a public facilities fee. The EIR (EIR 91-2) identified a number of potentially significant impacts created by this project and possible mitigation measures to reduce these impacts to a level of insignificance. These mitigation measures have been incorporated into the project through redesign or conditions of approval, to reduce all impacts to a level of insignificance. The applicant is by condition, required to pay any increase in public facility fee, or new construction tax, or development fees, and has agreed to abide by any additional requirements established by a Local Facilities Management Plan prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensure continued availability of public facilities and will mitigate any cumulative impacts created by the project. This project is consistent with the City's Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 24. This project was subject to Chapter 21.95 of the Carlsbad Municipal Code (Hillside Ordinance) and meets all the requirements of that Chapter to ensure the sensitive treatment of the City's hillside resources. This Special Use Permit required pursuant to Section 21.40.040 of the Scenic Preservation Overlay Zone is approved as the project complies with all requirement of the El Camino Real Corridor Development Standards for Area 3. Approval is granted for SUP 91-2, as shown on Exhibit(s) "A" - "AA", dated Februaq 19, 1992, incorporated by reference and on file in the Planning Department Development shall occur substantially as shown unless otherwise noted in thesl conditions. 2. The developer shall provide the City with a reproducible 24" x 36', mylar copy c the Tentative Map (Exhibit "H", Composite Tentative Map, and Exhibits "Q! - "A-A' 50 scale Tentative Map) as approved by the Planning Commission. The Tentativ Map shall reflect the conditions of approval by the City. The map copy shall b submitted to the City Engineer prior to issuance of building permits or improvemer plan submittal, whichever occurs first. 24 25 3.
