A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE
GENERALLY LOCATED ON THE EAST SIDE OF AVENIDA
ENCINAS, SOUTH OF PALOMAR AIRPORT ROAD.

project, ensured building permits will not be issued for the project unless the Cit
Engineer determines that sewer service is available, and building cannot occu

Commission is satisfied that the requirements of the Public Facilities Element of th
General Plan have been met insofar as they apply to sewer service for this projecl

9. The appxcant has agreed and is reqdred by the inclusion of an appropdatc condition to pay a public facilities fee. Performance of that contract and paymen
of the fee will enable this body to find that public facilities will be availablt
concurrent with need as required by the General Plan.
10. This project will not cause any significant environmental impacts and a Negativc
Declaration has been issued by the Planning Director on January 16, 1992 an(
recommendation for approval by the Planning Commission on February 19,1992
In approving this Negative Declaration the Planning Commission has considered thc
initial study, the staff analysis, all required mitigation measures and any writtel
comments received regarding the significant effects this project could have on thc

11. The applicant is by condition, required to pay any increase in public facility fee, o
new construction tax, or development fees, and has agreed to abide by an
additional requirements established by a Local Facilities Management Plan preparec
pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensur
continued availability of public facilities and will mitigate any cumulative impact
created by the project.

The developer shall provide the City with a reproducible 24" x 36", mylar copy c
the Site Plan as approved by the Planning Commission. The Site Plan shall reflec
the conditions of approval by the City. The Plan copy shall be submitted to the Cit
Engineer prior to building, grading or improvement plan submittal, whicheve
occurs first.
This project is approved upon the express condition that building permits will nc
be issued for development of the subject property unless the City Engineā¬
determines that sewer facilities are available at the time of application for suc
sewer permits and will continue to be available until time of occupancy.

4. This project is also approved under the express condition that the applicant pay the
public facilities fee adopted by the City Council on July 28, 1987 and as amended
from time to time, and any development fees established by the City Council
pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance
adopted to implement a growth management system or facilities and improvement
plan and to fulfill the subdivider's agreement to pay the public facilities fee dated,
January 30, 1992, a copy of which is on file with the City Clerk and is incorporated
by this reference. If the fees are not paid this application will not be consistent with
the General Plan and approval for this project will be void.
5. The applicant shall provide school fees to mitigate conditions of overcrowding as
part of building permit application. These fees shall be based on the fee schedule
in effect at the time of building permit application.
6. Water shall be provided to this project pursuant to the Water Service agreement
between the City of Carlsbad and the Carlsbad Municipal Water District, dated
May 25, 1983.
7. This project shall comply with all conditions and mitigation required by the Zone
3 Local Facilities Management Plan approved by the City Council on May 19,1987,
incorporated herein and on file in the Planning Department and any future
amendments to the Plan made prior to the issuance of building permits.
8, Approval of this request shall not excuse compliance with all sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building
permit issuance.
9. This approval shall become null and void if building permits are not issued for thi:
project within two years from the date of project approval.
10. Prior to the approval of grading plans, the project applicant shall receive a Coasta
Development Permit from the California Coastal Commission that approve:
development that is in substantial conformance with the City approval. Evidencc
that the permit has been received shall be submitted to both the Planning an(
