CASE NAME: PHILLIPS SEAWALL CASE NO: SUP 91-8 WHEREAS, a verified application for certain property, to wit: Lots 17 and 18 in Block "A" of Hayes Land Company addition to Carlsbad, Map No. 2, per Map 1221, in the City of Carlsbad, Couty of San Diego, State of California. has been filed with the City of Carlsbad, and referred to the Planning Commission; aI: WHEREAS, said application constitutes a request as provided by Title 21 ( the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 1st day of April, 1992, ho: a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering 2 testimony and arguments, if any, of all persons desiring to be heard, said Commissic considered all factors relating to the Special Use Permit; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. No state or federal permits are required, other than a Coastal Development Per issued by the California Coastal Commission. 3. The construction of the seawall will keep the site relatively safe from flooding diverting storm and surge waters away from the usable rear yard. 4. The proposed development does not adversely affect the carrying capacities areas where base flood elevations have been determined since no base fl~ elevations exist along the coastal beach. Conditions: 1. Approval is granted for SUP 91-8, as shown on Exhibits "A" - "D", da April 1, 1992, incorporated by reference and on file in the Planning Departmc Development shall occu substantially as shown unless otherwise noted in th conditions. 2. Approval of this request shall not excuse compliance with all sections of Zoning Ordinance and all other applicable City ordinances in effect at time building permit issuance. 3. Approval of SUP 91-8 is granted subject to the approval of HDP 91-19. 4. Approval of SUP 91-8 is granted subject to approval of the proposed construct by the California Coastal Commission. Alterations to the project design requi as determined by the Planning Director. by the Coastal Commission may necessitate amendment of this Speaal Use Pern 4. preliminary landscape plans shall be submitted for review and approval prior the issuance of building permits.
