HomeMy WebLinkAbout1992-04-01; Planning Commission; Resolution 3378I RZ e 0 PLANNING COMMISSION RESOLUTION NO. 3378 1 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN EXTENSION OF TIME FOR TENTATIVE MAP. CASE NAME: CASA DEL SOL CASE NO: CT 89-23 WHEREAS, the Planning Commission did, on February 21,1990 adopt Resolution 6 No. 2976 approving the tentative map for a 12 lot subdivision, known as CT 89-23, and 7 WHEREAS, said tentative map will have expired as of February 21, 1992, and 8 9 10 11 12 13 WHEREAS, the project can be found to be in conformance with the General Plan, 14 Title 21, other City ordinances and current City policies with imposition of additional I.5 conditions; and 16 17 18 19 WHEREAS, the applicant for the tentative map, El Fuerte Limited has requested an extension of time to process toward a final map, and WHEREAS, the applicant has been limited due to the poor economy from diligently pursuing a final map, and WHEREAS, the applicant has consented to the imposition of the additional conditions which are needed to bring the tentative tract map into conformance with the General Plan, Title 21, other City ordinances and current City policies. 20 NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City 21 of Carlsbad, California as follows: 22 1. That the above recitations are true and correct. 23 2. That the request for an extension of time for the tentative tract map for 24 Carlsbad Tract 89-23 be approved for a period of one year from February 21, 1992 until February 21,1993, subject to all the original conditions of 25 approval with one modification (Conditon No. 34) and the following 26 /1 /// additional conditions: 27 II 28 li -3 0 0 Conditions 3 2 1. Condition No. 34 is modified to read: Modified Condition 3 4 5 6 7 a 9 10 1 "NO grading shall occur outside the limits of the subdivision unless a construction easement is obtained from the owners of the affected properties." Additional Conditions: 2. The applicant shall defend, indemnify and hold harmless the City and its agents, officers, and employees from any claim, action or proceeding against the City or its agents, officers, or employees to attack, set aside, void or null an approval of the City, the Planning Commission or City Engineer which has been brought against the City within the time period provided by Section 66499.37 of the Subdivision Map Act. 11 12 13 14 3. Prior to approval of the final map for this project, the applicant shall enter into an agreement with the City to provide this project's proportional share of the City's total obligation for low income housing units or to implement whatever housing programs are adopted by the City Council to implement the Housing Element. 5. The applicant shall agree to utilize reclaimed water, in Type I form, on the subject property in all common areas as approved by the City Engineer. Reclaimed water, as defined in Section 1305(n) of the California Water Code, means water which, as a result of treatment of wastewater, is suitable for a direct beneficial use or controlled use that would not otherwise OCCUI. /// /// /// /// 27 /I P.C. RESOLUTION NO. 3378 -2- 28 r+ I1 e 0 1 2 3 6. Irrigation systems to accommodate future reclaimed water shall be designed consistent with Title 17 of the California Code of Regulations. Offsite future reclaimed water distribution systems should be anticipated by the installation of adequately sized sleeves at crossing points to minimize street excavation. 4 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad 5 Planning Commission held on the 1st day of April, 1992 by the following vote, to wit: 6 7 €3 9 10 AYES: Chairman Erwin, Commissioners: Schlehuber, Schramm, Holmes, Savary, Noble & Hall.
