CASE NAME: LA COSTA FAIRWAY VILLAS CASE NO: HDP 91-10 WHEREAS, a verified application for certain property to wit: Parcel A: Lots 399 and 400 of La Costa South Unit No. 5, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 6600, filed in the office of the County Recorder of San Diego County, March 10, 1970. Parcel B: Lot 401 of La Costa South Unit No. 5, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 6600, filed in the Office of The County Recorder, March 10, 1970, has been filed with the City of Carlsbad and referred to the Planning Commission; an' WHEREAS, said verified application constitutes a request as provided t Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 6th day of May, 199; consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony an arguments, if any, of all persons desiring to be heard, said Commission considered a factors relating to the Hillside Development Permit; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissia as follows: ~ A) That the foregoing recitations are true and correct. ~ B) That based on the evidence presented at the public hearing, the Commissio APPROVES HDP 91-10, based on the following findings and subject to th following conditions: ,I .... .... That undevelopable areas of the project have been properly identified; 3. That areas previously disturbed by authorized grading have been fully idenfie an may be excluded from the requirements of Chapter 21.95; 4. That areas of topographic change less than 15 feet in height and less than 4,OO square feet in area have been properly identified and may be excluded from tk requirements of Chapter 21.95; 5. That the site's pregraded condition severely constrains site plan development. 6. That approval of specific exclusions allowed by Chapter 21.95 permit a superic site design. 7. That by exclusion of areas previously disturbed by authorized grading and are; of topographic change less than 15 feet in height and 4,000 square feet in aei no development or grading will occur in those portions of the property which ar undevelopable pursuant to the provision of section 21.53.230 of the Municipi Code; 8. That the project design and lot configuration minimizes, to the greatest exta possible for the specific proposal, disturbance of hillside lands, 9. That the project split pad and residential split level design with the use ( integrateUexposed retaining walls substantially conforms to the intent of tk concepts illustrated in the Hillside Development Guidelines Manual; 10. That the development proposal is consistent with the purpose, intent, an requirements of Chapter 21.95. Conditions: 1. Approval of HDP 91-10 is granted subject to the approval of CT 91-5. 2.
