CASE NAME: LEVANTE STREET TOWNHOMES DEVELOPMENT PLAN NO. SDP 92-2 ON PROPERTY CASE NO: SDP 92-2 6 II WHEREAS, a verified application has been filed with the City of Carlsbad and 7 11 referred to the Planning Commission; and 8 9 WHEREAS, said verified application constitutes a request as provided by Title 10 11 WHEREAS, pursuant to the provisions of the Municipal Code, the Plannins 12 Commission did, on the 20th day of May, 1992, consider said request on propem 21 of the Carlsbad Municipal Code; and l3 described as: 14 15 16 Lots 230 and 231 of La Costa Vale Unit No. 1 according to recorded map thereof No. 7457 in the City of Carlsbad, California. l? /I WHEREAS, at said public hearing, upon hearing and considering all testimoq 18 19 factors relating to SDP 92-2. and arguments, if any, of all persons desiring to be heard, said Commission considered a] 20 21 22 23 24 25 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissic APPROVES SDP 92-2, based on the following findings and subject to the followir conditions: 26 27 Findins: 28 1. The project is consistent with the City‘s General Plan since the proposed density 10.6 du’s/acre is within the density range of 8-15 du’s/acre specified for the site indicated on the Land Use Element of the General Plan, and is at or below tl growth control point of 11.5. The applicant s b condition, required to pay any increase in public facility fee, ( new construc ion tax, or development fees, and has agreed to abide by ar pursuant to hapter 21.90 of the Carlsbad Municipal Code. This will ensu continued ava lability of public facilities and will mitigate any cumulative impac created by the project.
