I- a 0 1 2 3 4 5 PLANNING COMMISSION RESOLUTION NO. 3397 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A PLANNED UNIT DEVELOPMENT PERMIT ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF BATIQUITOS DRIVE. CASE NAME: AVIARA PLANNING AREA 30 CASE NO: PUD 91-6 6 /I WHEREAS, a verified application for certain property to wit: 7 8 9 Portions of Sections 27, 28, 33, and 34, Township 12 South, Range 4 West, San Bernardino Meridian, in the City of Carlsbad, County of San Diego. 10 11 has been filed with the City of CarIsbad and referred to the Planning Commission; and 11 11 WHEREAS, said verified application constitutes a request as provided by Tit! 12 I.4 WHEREAS, the Planning Commission did, on the 20th day of May, 199: 13 21 of the Carlsbad Municipal Code; and hold a duly noticed public hearing as prescribed by law to consider said request; and 15 11 WHEREAS, at said public hearing, upon hearing and considering all testimor 16 /I 17 I/ and arguments, if any, of all persons desiring to be heard, said Commission considered s 18 factors relating to the Planned Unit Development. 19 as foUows: 20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissic 21 A) That the above recitations are true and correct. 22 23 24 B) That based on the evidence presented at the public hearing, the Commissii recommends APPROVAL of PUD 91-6, based on the following findings a: subject to the following conditions: 25 26 28 (Zoning); 27 1. Chapter 20.16.010 (Subdivisions) of the Carlsbad Municipal Code requires tl I Fhdings: every lot front on a dedicated street unless otherwise authorized by Title 2. The proposed project is for a gated community, thus requiring private streets; 4. This PUD is for purposes of creating and maintaining private streets o&; 5. The residential lots proposed by this project will be developed to R-1 standards : specified in the Aviara Master Plan (MP 177) rather than to the PUD standards; Conditions: 1. Approval of PUD 91-2 is granted subject to the approval of CT 90-30, Plannin Commission Resolution No. 3396. 2. Approval of PUD 91-2 is granted subject to all conditions of CT 90-30, Plannin Commission Resolution No. 3396, incorporated herein by reference and on file j the Planning Department. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Plannin Commission of the City of Carlsbad, California, held on the 20th day of May, 1992, by th following vote, to wit: AYES: Commissioners: Schlehuber, Schramm, Noble, Welshon Savary & Hall.
