A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE
CONSTRUCTION OF A 11,556 SQUARE FOOT
OFFICE/WAREHOUSE BUILDING ON PROPERTY GENERALLY
LOCATED ON THE NORTH SIDE OF IMPALA DFUVE
BETWEEN ORION WAY AND PALMER WAY.

WHEREAS, a verified application has been filed with the City of Carlsbad an(
referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by Titlc
21 of the Carlsbad Municipal Code; and

WHEREAS, at said public hearing, upon hearing and considering all testimony

factors relating to SDP 92-4, 20
1 and arguments, if any, of all persons desiring to be heard, said Commission considered all

detrimental to existing uses or to uses specifically permitted in the area, and not
detrimental to the site, surroundings, or traffic circulation because the proposed
development provides adequate off-street parking, landscaping, onsite circulation
and loading areas.
The site for the intended development is adequate in size and shape to
accommodate the proposal because the proposed project complies with all applicable
ordinances regarding site development standards while keeping with the existing
constraints of the site.

All yards, setbacks, walls, fences, landscaping, and other features necessary to adjust
the proposed development to exkting or pedtted future uses in the neighborhood
will be provided and maintained as the site design is compatible with neighboring
developments and all existing and proposed landscaped areas are conditioned to be
provided and to remain intact.
The street system serving the proposed development is adequate to properly handle
all traffic generated by the proposed development as the site is served by fully
improved, local streets capable of accommodating the 102 average daily trips
generated by the proposal.
The Planning Commission has, by inclusion of an appropriate condition to this
project, ensured building permits will not be issued for the project unless the City
Engineer determines that sewer service is available, and building cannot occur
within the project unless sewer service remains available, and the Planning
Commission is satisfied that the requirements of the Public Facilities Element of the
General Plan have been met insofar as they apply to sewer service for this project.
The applicant has agreed and is required by the inclusion of an appropriate
condition to pay a public facilities fee. Performance of that contract and payment
of the fee will enable this body to find that public facilities will be available
concurrent with need as required by the General Plan.
This project is consistent with the City's Growth Management Ordinance as it has
been conditioned to comply with any requirement approved as part of the Local
Facilities Management Plan for Zone 5.

8. The proposed development is consistent with the Comprehensive Land Use Plan for
McClellan-Palomar Airport.

25 1. Approval is granted for SDP 92-4, as shown on Exhibits "A" - "I", dated June 17,
1992, incorporated by reference and on file in the Planning Department.
26 Development shall occur substantially unless otherwise noted in these conditions.
27 2. The developer shall provide the City with a reproducible 24" x 36", mylar copy of
28 the Site Plan as approved by the Planning Commission. The Site Plan shall reflect

the conditions of approval by the City. The Site Plan copy shall be submitted to the City Engineer prior to issuance of building permits or improvement plan submittal,
whichever occurs first.
This project is approved upon the express condition that building permits will not
be issued for development of the subject property unless the City Engineer
determines that sewer facilities are available at the time of application for such
sewer permits and will continue to be available until time of occupancy.
This project is also approved under the express condition that the applicant pay the
public facilities fee adopted by the City Council on July 28, 1987 and as amended
from time to time, and any development fees established by the City Council
pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance
adopted to implement a growth management system or facilities and improvement
plan and to fulfill the subdividefs agreement to pay the public facilities fee dated
December 21, 1991, a copy of which is on file with the City Clerk and is
consistent with the General Plan and approval for this project will be void.
