HomeMy WebLinkAbout1992-06-17; Planning Commission; Resolution 3412‘I 0 0 1 2 3 4 5 6 7 8 9 10 11 12 PLANNING COMMISSION RESOLUTION NO. 3412 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE CONSTRUCTION OF A 11,556 SQUARE FOOT OFFICE/WAREHOUSE BUILDING ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF IMPALA DFUVE BETWEEN ORION WAY AND PALMER WAY. CASE NAME: PENTON OVERSEAS DEVELOPMENT PLAN NO. SDP 92-4 TO ALLOW CASE NO: SDP 92-4 WHEREAS, a verified application has been filed with the City of Carlsbad an( referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Titlc 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Planning 13 described as: l4 Commission did, on the 17th day of June, 1992, consider said request on propem 15 16 17 18 Parcel 4 of Parcel Map 12855 in the City of Carlsbad, County of San Diego, State of California, filed in the office of the San Diego County Recorder on August 24, 1983. The proposed development is properly related to the site, surroundings, and 28 Findings: 27 conditions: B) That based on the evidence presented at the public hearing, the Commission APPROVES SDP 92-4, based on the following findings and subject to the following environmental setting, consistent with the various elements of the general plan, not I) e 0 1 2 3 4 5 2 detrimental to existing uses or to uses specifically permitted in the area, and not detrimental to the site, surroundings, or traffic circulation because the proposed development provides adequate off-street parking, landscaping, onsite circulation and loading areas. The site for the intended development is adequate in size and shape to accommodate the proposal because the proposed project complies with all applicable ordinances regarding site development standards while keeping with the existing constraints of the site. 6 3. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 4. 5. 6. 7. All yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the proposed development to exkting or pedtted future uses in the neighborhood will be provided and maintained as the site design is compatible with neighboring developments and all existing and proposed landscaped areas are conditioned to be provided and to remain intact. The street system serving the proposed development is adequate to properly handle all traffic generated by the proposed development as the site is served by fully improved, local streets capable of accommodating the 102 average daily trips generated by the proposal. The Planning Commission has, by inclusion of an appropriate condition to this project, ensured building permits will not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project. The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. This project is consistent with the City's Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 5. 22 23 8. The proposed development is consistent with the Comprehensive Land Use Plan for McClellan-Palomar Airport. I1 Planning Conditions: 24 25 1. Approval is granted for SDP 92-4, as shown on Exhibits "A" - "I", dated June 17, 1992, incorporated by reference and on file in the Planning Department. 26 Development shall occur substantially unless otherwise noted in these conditions. 27 2. The developer shall provide the City with a reproducible 24" x 36", mylar copy of 28 the Site Plan as approved by the Planning Commission. The Site Plan copy shall be submitted to the City Engineer prior to issuance of building permits or improvement plan submittal, whichever occurs first. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfill the subdividefs agreement to pay the public facilities fee dated December 21, 1991, a copy of which is on file with the City Clerk and is consistent with the General Plan and approval for this project will be void. All parking lot trees shall be a minimum of 15 gallons in size. 4 5 6 7 13. All landscaped areas shall be maintained in a healthy and thriving condition, fre from weeds, trash, and debris. 14. The developer shall install street trees at the equivalent of 40-foot intervals alon: all public street frontages in conformance with the City of Carlsbad standards. Thi trees shall be of a variety selected from the approved Street Tree List. 8 15. All landscape plans shall be prepared to conform with the Guidelines Manual an( submitted per the landscape plan check procedures on file in the Planninj 9 Department. lo 11 16. Landscape plans shall be designed to minimize water use. Lawn and other Zone I plants (see Guidelines Manual) shall be limited to areas of special visual importancf or high use. Prior to final occupancy, a letter from a California licensed landscape architect shall be submitted to the Planning Director certifying that all landscaping has been installed as shown on the approved landscape plans. 20. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. 22 22. The first set of landscape and irrigation plans submitted shall include building plans, improvement plans and grading plans. 23 24 25 shall match the grading plans in terms of scale and location of improvements. 24.
