PLANNING COMMISSION RESOLUTION NO. 3398
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DENYING AN APPEAL OF
A PLANNING DIRECTOR DECISION THAT PROPOSED
SUBSTANTIAL, CONFORMANCE WITH THE PLANNING
COMMISSION APPROVAL ON PROPERTY GENERALLY
LOCATED ON THE SOUTHWEST CORNER OF EL CAMINO
REAL AND ALGA ROAD.
CASE NAME: AYRES SENIOR CENTER APPEAL OF A
REVISIONS TO CUP 88-21 (A)/SUP 89-5(A) ARE NOT IN
PLANNING DIRECTOR DECISION
CASE NO: CUP 88-21(A)/SUP 89-5(A)
WHEREAS, a verified application has been filed with the City of Carlsbac
and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
Commission did, on the 20th day of May, 1992, the 3rd day of June, 1992, the 17th of
June, 1992, and the 1st day of July, 1992, hold a duly noticed public hearing to consider
said application on property described as:
Lot 1 of Carlsbad Tract 72-34 Unit No. 1, in the City of
Carlsbad, County of San Diego, State of California, according
to Map thereof No. 8350, as recorded in the Office of the
County Recorder of San Diego County dated July 28, 1976.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said Commission
considered all factors relating to an appeal of a Planning Director Decision pursuant to
Carlsbad Municipal Code, Section 21.54.140 that proposed revisions are not in substantial
conformance with the Planning Commission approval of CUP 88-21(A)/SUP 89-5(A).
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission
of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, ,the Commissio~
DENIES the appeal and upholds the decision of the Planning Director tha
proposed revisions to CUP 88-21(A)/SUP 89-5(A) are not in substantia
conformance with the previous approval.
Findings:
1. Enclosure of the patios and balconies to turn them into sun rooms eliminates al
private outdoor space for each unit, adds additional building floor area of ove
8,997 square feet which when added to the total square footage already approva
administratively exceeds 10 percent of the total building area, and changes thf
exterior building elevations which is not in conformance with the approved projec
exhibits.
