CASE NAME: CALAVERA HILLS VILLAGE "L-1" CASE NO: PUD 92-6 ~ 6 I/ WHEREAS, a verified application for certain property to wit: 7 8 9 Lot 1 of Carlsbad Tract No. 85-30 in the City of Carlsbad, County of San Diego, State of California; According to Map thereof No. 11826, Filed in the Office of the County Recorder of San Diego County, May 9, 1987. The Planning Commission has, by inclusion of an appropriate condition to this project, ensured building permits will not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project. 4. School fees will be paid to ensure the availability of school facilities in the Carlsbad Union School District. 5. All necessary public improvements have been provided or will be required as conditions of approval. 6. The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available I concurrent &th need as required by the General Plan. I 14 7. The proposed project is consistent with the City's Planned Development Ordinance and also complies with the Design Guidelines Manual. 15 16 17 18 19 20 21 22 23 24 25 26 27 28 8. The proposed project is compatible with the surrounding future land uses since surrounding properties are designated for residential development on the General Plan. 9. This project will not cause any significant environmental impacts and a Negative Dec1aratio:n has been issued by the Planning Director on April 30, 1992 and recommended for approval by the Planning Commission on July 15, 1992. In approving this Negative Declaration the Planning Commission has considered the initial study, the staff analysis, all required mitigation measures and any written comments received regarding the significant effects this project could have on the environment. 10. The applicant is by condition, required to pay any increase in public facility fee, oj new construction tax, or development fees, and has agreed to abide by an! additional requirements established by a Local Facilities Management Plan prepare( pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensurf continued availability of public facilities and will mitigate any cumulative impact created by the project. 11. This project is consistent with the City's Growth Management Ordinance as it ha: been conditioned to comply with any requirement approved as part of the Loca Facilities :Management Plan for Zone 7. 1) pc RESO No 3405 2 + , . ll 0 0 12. The granting of this permit will not adversely affect and will be consistent with 1 Chapter 21.45, the Calavera Hills Master Plan, and all adopted plans of the city and other governmental agencies. 2 3 4 13. The project is necessary and desirable to provide a range of housing which will contribute to the long-term well being of the neighborhood and the community. 14.
