PLANNING COMMISSION RESOLUTION NO. 3419
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING AN
EXTENSION OF A CONDITIONAL USE PERMIT TO ALLOW
FOR THE CONTINUED USE OF FNE TEMPORARY
MODULAR BUILDINGS ON PROPERTY GENERALLY
LOCATED ON THE NORTHEAST AREA OF THE SAFETY
SERVICES CENTER ON ORION WAY.
CASE NAME: CITY OF CARLSBAD
CASE NO: CUP 295x1
WHEREAS, a verified application has been filed with the City of Carlsbad
and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Planniq
Commission did, on the 19th day of August, 1992, hold a duly noticed public hearing tc
consider said application on property described as:
A Portion of Lots A and B of Rancho Agua Hedionda,
according to Map 823 filed November 16, 1896.
WHEREAS, at said public hearing, upon hearing and considering al'
testimony and arguments, if any, of all persons desiring to be heard, said Comrnissio~
considered all factors relating to CUP 295x1.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio:
of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commissic
APPROVES CUP 295x1, based on the following findings and subject to tk
following conditions:

1. That the requested use continues to be necessary or desirable for the develop me^
of the community, is essentially in harmony with the various elements ar

objectives of the general plan, and is not detrimental to existing uses or to us
specifically permitted in the zone in which the proposed use is to be located;
2 2. That the site for the intended use is still adequate in size and shape

accommodate the use by the provision of increased setbacks and landscaping
screen the use;
3. That all of the yards, setbacks, walls, fences, landscaping, and other featur
5 necessary to adjust the requested use to existing or permitted future uses in t
neighborhood have been and will continue to be provided and maintained; 6

4. That the street system serving the proposed use is still adequate to properly hanc

All conditions of approval imposed upon CUP 295 as stated in Planni
Commission Resolution 2622 shall apply as conditions of approval for CUP 295
except for Condition No. 6, which is replaced by Condition No. 2 of Planni
Commission Resolution No. 3419.
This conditional use permit is granted for a period of five years from October
1991 (the date of expiration of the original permit). This conditional use pem
shall be reviewed by the Planning Director on a yearly basis to determine if
conditions of this permit have been met and that the use does not have
significant detrimental impact on surrounding properties or the public health a:
welfare. If the Planning Director determines that the use has such significa
adverse impacts, the Planning Director shall recommend that the Planni
Commission, after providing the permittee the opportunity to be heard, a’
additional conditions to mitigate the significant adverse impacts. This permit m
be revoked at any time after a public hearing, if it is found that the use has
significant detrimental affect on surrounding land uses and the public’s health a
welfare, or the conditions imposed herein have not been met. This permit may
