PLANNING COMMISSION RESOLUTION NO. 3427
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITYOF CARLSBAD, CALIFORNIA, DETERMINING GENERAL
PLAN CONSISTENCY ON PROPERTY GENERALLY LOCATED
ON THE SOUTHEAST CORNER OF AVENIDA LA
POSTA/CALLE ACERVO AND RANCHO SANTA FE ROAD IN
CASE NAME: OLlVENHAIN ELEMENTARY SCHOOL
THE R-1-10 ZONE.
CASE NO: PCD/GPC 92-2
WHEREAS, a verified application for certain property to wit:
Portion of Lots 13 and 14 of the subdivision of the Rancho
Las Encinitas in the County of San Diego, State of California,
according to map thereof 848 filed in the office of the County
Recorder of San Diego County,
has been filed with the City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided b:
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 19th day of August, 1992
consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony an(
arguments, if any, of all persons desiring to be heard, said Commission considered a1
factors relating to the Planning Commission Determination; and
WHEREAS, the School District has requested the City to not oppose th
acquisition,
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio:
as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commissio
APPROVES PCD 92-2, based on the following findings and subject to the followin
conditions:

FINDINGS:
1. The proposed school site at the location specified above, is consistent with tht
Land Use and public Facility Elements of the General Plan as required by Sectio~
21151.2 of the Public Resource Code and 65402(C) of the Government Code sinc~
it provides a balance of public and private land uses within convenient an(
compatible locations and assures that adequate public schools are available to mee
existing and future demand.
2. The Planning Director has determined that the proposed school site has receivec
prior environmental review through the certification of an EIR by the Encinita
Union School District in July, 1991.
3. There is no environmental basis for opposition to the acquisition.
4. With the dedication of a Major and Collector street as defined in the Cirdatio~
Element, the project is consistent with the General Plan.
PLANNING CONDITIONS:
1. All recommendations proposed to mitigate any significant impacts identified fol
alternative No. 2 school site by the 0livenhai.n Elementary School EIR and tht
Shelley EIR (EIR 90-6) shall be implemented prior to or in conjunction with tht
construction of a school facility.
