PLANNING COMMISSION RESOLUTION NO. 3421
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CITY OF CARLSBAD, CALIFORNIA, APPROVING A
MINOR AMENDMENT TO PLANNED UNIT DEVELOPMENT
61(A) TO ADD AN ADDITIONAL 276 SQUARE FEET OF
FLOOR AREA TO A SINGLE FAMILY HOME LOT LOCATED
AT 820 SKYSAIL AVENUE.
CASE NAME: KELLOGG ADDITION
CASE NO: PUD 61(B)
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning CommissioI
of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented, the Commission DETERMINES tha
the proposed addition is minor and APPROVES Planned Unit Developmen
61(B), in accordance with the procedures outlined in Subsectio~
21.45.160(a)(2) of the Zoning Ordinance based on the following finding
and subject to the following conditions.
Findins:
1. The proposed project is consistent with the City's Planned Development Ordinancl
and also complies with the Design Guidelines Manual.
2. The proposed project is considered minor in nature according to Subsectio:
21.45.160(a)(3) of the Zoning Ordinance.
4 The City Engineer has issued a standards variance indicating that the findings ca
be made for providing safe site distance for autos or pedestrians commuting nort
on Harbor Pointe Road or entering Harbor Pointe Road from Skysail Avenue.
5. The proposed project is a Class 1 Exemption per Subsection 15301(e)(l) of th
California Environmental Quality Act.
Conditions:
1. Approval is granted for PUD 61(B), as shown on Exhibit(s) "A" - "B", date
September 2, 1992, incorporated by reference and on file in the Plannin
Department. Development shall occur substantially as shown unless otherwi:
noted in these conditions.
2. Approval of this request shall not excuse compliance with all sections of tl: Zoning Ordinance and all other applicable City ordinances in effect at time (
building permit issuance.

3. Prior to issuance of building permits, the applicant shall obtain a permit from th
California Coastal Commission. If the project is exempt from Coastal Perm
requirements, then proof of such exemption must be provided by the Califonni
Coastal Commission prior to the issuance of building permits.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Plannin
Commission of the City of Carlsbad, California, held on the 2nd day of September, 199:
by the following vote, to wit:
AYES: Chairperson Erwin, Commissioners: Schlehuber, Schramn
Noble, Welshons, Savary & Hall.
NOES: None.
ABSENT: None.
