PLANNING COMMISSION RESOLUTION NO. 3431
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL, USE PERMIT TO
ALLOW IMPROVEMENTS TO THE EXISTING BUENA VISTA PUMP
STATION ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF
JEFFERSON STREET, NORTH OF THE BUENA VISTA CREEK, SOUTH OF
CASE NAME: BUENA VISTA PUMP STATION IMPROVEMENTS
HIGHWAY 78 - APN: 156-301-01/02.
CASE NO: CUP 92-06
WHEREAS, a verified application has been filed with the City of Carlsbad anc
referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by Title 21
of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Planninj
Commission did, on the 7th day of October, 1992, hold a duly noticed public hearing tc
consider said application on property described as:
A portion of Lot 32 of Hosp Eucalyptus Forest Tract No. 1 according
to Map No. 1136, as recorded in the office of the San Diego
Recorder on June 8, 1908.
WHEREAS, at said public hearing, upon hearing and considering all testimony anc
arguments, if any, of all persons desiring to be heard, said Commission considered a
factors relating to CUP 92-06.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of th
City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commissio
APPROVES CUP 92-06, based on the following findings and subject to th
following conditions:

FiIldinES:
1. That the requested use is necessary or desirable for the development of the
community, is essentially in harrnony with the various elements and objectives of
the general plan, and is not detrimental to existing uses or to uses specifically
permitted in the zone in which the proposed use is to be located; the proposed
improvements will increase the station's pumping capacity and upgrading the
public facility is consistent with the goals and objectives of the General Plan;
2, That the site for the intended use is adequate in size and shape to accommodate the use; all proposed improvements can be easily accommodated on the existing
pump station pad;
3. That all of the yards, setbacks, walls, fences, landscaping, and other features
necessary to adjust the requested use to existing or permitted future uses in the
neighborhood will be provided and maintained; the building construction and
proposed landscaping is designed to eliminate any offsite impacts to adjacent
vacant or non-developable areas;
4. That the street system serving the proposed use is adequate to properly handle all
traffic generated by the proposed use. The existing Jefferson Street roadway and
existing access road is adequate to properly handle the maintenance vehicle traffic
that will be generated by this project.
5. This project will not cause any significant environmental impacts and a Negative
Declaration has been issued by the City of Vista Planning Director on July 1,1992
and approved by the Planning Commission on October 7, 1992. In approving this
Negative Declaration the Planning Commission has considered the initial study, the
staff analysis, all required mitigation measures and any written comments receivec
regarding the significant effects this project could have on the environment.
6. This project is consistent with the City's Growth Management Ordinance as it ha:
been conditioned to comply with any requirement approved as part of the Loca
Facilities Management Plan for Zone 1.
7. This project is consistent with all applicable policies of the MeUo I1 Local Coasta
PrOgram.
Planning Conditions:
1. Approval is granted for CUP 92-06, as shown on Exhibits "A" - "K", datec
October 7, 1992, incorporated by reference and on file in the Plannin:
Department. Development shall occur substantially as shown unless othenvis
noted in these conditions.
2. The developer shall provide the City with a reproducible 24" x 36", mylar copy c
the site plan as approved by the Planning Commission. The site plan shall reflec:

the conditions of approval by the City. The plan copy shall be submitted to the
City Engineer and approved prior to building, grading, final map, or improvemenl
plan submittal, whichever occurs first.
3. This project shall comply with all conditions and mitigation required by tht
Zone 1 Local Facilities Management Plan approved by the City Council or
September 1, 1987, incorporated herein and on file in the Planning Departmenl
and any future amendments to the Plan made prior to the issuance of building
permits.
4. If any condition for construction of any public improvements or facilities, or thc
payment of any fees in lieu thereof, imposed by this approval or imposed by law
on this project are challenged this approval shall be suspended as provided ir
Government Code Section 65913.5. If any such condition is determined to bt
invalid this approval shall be invalid unless the City Council determines that thc
project without the condition complies with all requirements of law.
5. Approval of this request shall not excuse compliance with all sections of thc
Zoning Ordinance and all other applicable City ordinances in effect at time 0.

6. Approval of CUP 92-06 is granted subject to the approval of SUP 92-03.
7. This conditional use permit is granted for a period of ten (10) years. Thi!
conditional use permit shall be reviewed by the Planning Director on a yearly basil
to determine if all conditions of this permit have been met and that the use doe!
not have a significant detrimental impact on surrounding properties or the public
health and welfare. If the Planning Director determines that the use has suc€
significant adverse impacts, the Planning Director shall recommend that thf
Planning Commission, after providing the permittee the opportunity to be heard
add additional conditions to mitigate the significant adverse impacts. This permi
may be revoked at any time after a public hearing, if it is found that the use ha:
a significant detrimental affect on surrounding land uses and the public’s healtl
and welfare, or the conditions imposed herein have not been met. This permi
may be extended for a reasonable period of time not to exceed ten (10) years up01
expiration date. In granting such extension, the Planning Commission shall fin(
that no substantial adverse affect on surrounding land uses or the public’s healtl
and welfare will result because of the continuation of the permitted use. If i

welfare is found, the extension shall be considered as an original application fo

9. No outdoor storage of material shall occur onsite unless required by the Fire Ch;ef.
In such instance a storage plan will be submitted for approval by the Fire Chief
and the Planning Director.
10. The applicant shall prepare a detailed landscape and irrigation plan which shall be
submitted to and approved by the Planning Director prior to the issuance of
grading or building permits, whichever occurs first. The installation of a reclaimed
water irrigation system to the satisfaction of the Carlsbad Water District, will be
required for future use.
11. All landscaped areas shall be maintained in a healthy and thriving condition, free
from weeds, trash, and debris.
12. All landscape plans shall be prepared to conform with the Landscape Manual and
submitted per the landscape plan check procedures on file in the Planning
Department.
13. Landscape plans shall be designed to minimize water use. Lawn and other zone
1 plants (see Landscape Manual) shall be limited to areas of special visual
importance or high use. Mulches shall be used and irrigation equipment and
design shall promote water conservation.
14. Prior to final occupancy, a letter from a California licensed landscape architect
shall be submitted to the Planning Director certifymg that all landscaping has been
installed as shown on the approved landscape plans.
15. The applicant shall pay a landscape plan check and inspection fee as required by
Section 20.08.050 of the Carlsbad Municipal Code.
16, The first set of landscape and irrigation plans submitted shall include building
plans, improvement plans and grading plans.
17. All landscape and irrigation plans shall show existing and proposed contours and
shall match the grading plans in terms of scale and location of improvements.
18. Any signs proposed for this development shall at a minimum be designed ir
conformance with the City's Sign Ordinance and shall require review and approva:
of the Planning Director prior to installation of such signs.
19. Building identification and/or addresses shall be placed on all new and existin:
buildings so as to be plainly visible from the street or access road; color o
identification and/or addresses shall contrast to their background color.
20. As part of the plans submitted for building permit plan check, the applicant shal
include a reduced version of the approving resolutions on a 24" x 36" bluelin
drawing. Said blueline drawingls) shall also include a copy of any applicabl
Coastal Development Permit and signed approved site plan.

21. Prior to the issuance of any building permits, a Coastal Development Permit shall
1 be obtained from the California Coastal Commission.
