PLANNING COMMISSION RESOLUTION NO. 3432
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A SPECIAL USE PERMIT TO
ALLOW IMPROVEMENTS TO THE EXISTING BUENA VISTA PUMP
STATION ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF
JEFFERSON STREET, NORTH OF THE BUENA VISTA CREEK, SOUTH OF
HIGHWAY 78. APN: 156-301-01/02.
CASE NAME: BUENA VISTA PUMP STATION IMPROVEMENTS
CASE NO: SUP 92-03
WHEREAS, a verified application for certain property, to wit:
A portion Lot 32 of Hosp Eucalyptus Forest Tract No. 1 according to Map
No. 1136, as recorded in the office of the San Diego Recorder on June 8,
1908.
has been filed with the City of Carlsbad, and referred to the Planning Commission; ant
WHEREAS, said application constitutes a request as provided by Title 21 of tht
Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 7th day of October, 1992, holc
a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony an(
arguments, if any, of all persons desiring to be heard, said Commission considered al
factors relating to the Special Use Permit; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of thc
City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing the Commissio~
APPROVES SUP 92-03, based on the following findings and subject to thc
following conditions:

1. All permit requirements of Chapter 21.110 of the Carlsbad Municipal Code haw
been satisfied.

2. The project is for proposed improvements to an c&sting sewer pump station and
the proposed improvements will be located outside the 100 year flood area and E
reasonably safe from flooding.
3. Since the project site is not in the 100 year floodway, there will be no impacts tc
the flood path or back water elevations and flooding hazards to other propertie
wiu not be increased.
4. The project will not adversely affect the carrying capacity of the floodway.
5. The proposed project is designed to be protected from flood damage so that nc
increase in flood related hazards will be created.
6. The project will not decrease the ability of the floodway to handle a 100 yea
flood event.
7. The extent of the flooding hazards involved with this project have been sufficientll identified to meet the requirements of FEMA and the City's Flood Plah
Management Ordinance.
Conditions:
1. Approval of SUP 92-03 is subject to the approval and conditions of CUP 92-6.

PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning
Commission of the City of Carlsbad, California, held on the 7th day of October 1992, by
the following vote, to wit:
AYES: Chairman Erwin, Commissioners: Schlehuber, Schramm, Noble,
Welshons & Savary.
NOES: None
ABSENT; Commissioner Hall.
ABSTAIN: None.
