HomeMy WebLinkAbout1992-10-07; Planning Commission; Resolution 34350 e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 3435 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A HILLSIDE DEVELOPMENT PERMIT TO ALLOW THE DEVELOPMENT OF A 42 ACRE COMMUNITY PARK ON PROPERTY GENERALLY LOCATED EAST OF PASEO DEL NORTE, SOUTH OF PALOMAR AIRPORT ROAD, AND NORTH OF CAMIN0 DE LAS ONDAS. CASE NAME: ALTA MIRA COMMUNITY PARK CASE NO: HDP 92-09 WHEREAS, a verified application has been fled with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did, on the 7th day of October, 1992, hold a duly noticed public hearing to consider said application on property described as: That portion of the west half of Section 21, Township 12 south, Range 4 west, San Bernardino Meridian, in the City of Carlsbad, County of San Diego, according to United States Government Survey; Lot 8 of Carlsbad Tract No. 72-23, according to map thereof No. 7683 filled in the office of the County Recorder of San Diego County June 29, 1973; Those portions of Lots 3 and 4, in Section 21, Township 12 south, Range 4 west, San Bernardino Meridian, according to the official plat. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to HDP 92-09. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. Hillside conditions have been properly identified on the constraints map which show existing and proposed conditions and slope percentages. 2. Undevelopable areas of the project, i.e. slopes over 40%, have been properly identified on the constraints map. 3. The development proposal is consistent with the intent, purpose, and requirements of the Hillside Development Ordinance, Chapter 21.95. 4. The grading design minimizes disturbance of hillside lands, 5. The project design substantially conforms to the intent of the concept illustrated in the Hillside Development Guidelines Manual. a. Grading Volumes per graded acre are within acceptable limits. b. The manufactured slopes are contoured and do not exceed 30 feet in height. Planning Conditions: 1. Approval is granted for HDP 92-09, as shown on Exhibits "A" - ".I", dated October 7, 1992, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. Approval of HDP 92-09 is granted subject to approval of CUP 92-05. 3. All conditions of Planning Commission Resolution No. 3434 and 3433, for CUP 92-05 and the Conditional Negative Declaration are applicable to this approval and incorporated herein through this reference. ~ .... .... .... .... .... ~ "" ....
