HomeMy WebLinkAbout1992-10-07; Planning Commission; Resolution 3438? 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 PLANNING COMMISSION RESOLUTION NO. 3438 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A HILLSIDE DEVELOPMENT PERMIT FORA SINGLE FAMILY RESIDENCE AND SHORELINE PROTECTION ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF TIERRA DEL ORO. CASE NAME: WELDON RESIDENCE CASE NO: HDP 91-23 WHEREAS, a verified application for certain property to wit: Lot 16 of Tierra Del Oro Subdivision, City of Carlsbad, County of San Diego, as per Map No. 3052 filed in San Diego County, February 4, 1954, has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Comm;ss;on did on the 7th day of October, 1992, consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Planning Commission Determination; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission APPROVES HDP 91-23, based on the following findings and subject to the following conditions: 25 I1 Findinzs: - 26 27 1. All of the findings of Planning Commission Resolution No. 3437, SUP 92-1, are 28 hereby incorporated by reference. 2. Hillside conditions have been properly identified. 3. The proposed project is consistent with the purpose, intent, and requirements o the Hillside Development Ordinance (Chapter 21.95) because it preserves tht natural appearance of the hillside, prevents erosion of the hillside, and does no preclude the reasonable use of a legally existing hillside parcel. 5. No development or grading will occur in those portions of the property which arc undevelopable pursuant to the provisions of Section 21.53.230 except that : modification to the hillside development and design standards is allowed becaust the site has unusual geotechnical or soil conditions that necessitate correctivt work. 6. The project design and lot configuration minimizes disturbance of hillside lands b; providing shoreline protection to prevent further erosion of the site. 7. The project design substantially conforms to the intent of the concepts illustrated in the hillside development guidelines manual by providing a variety of rooi heights, facade variations, and using contrasting building materials. 8. The project includes a modification to the development and design standards because the site has unusual geotechnical or soil conditions that necessitate corrective work. Conditions: 1. Approval is granted for HDP 91-23, as shown on Exhibits "A"-"G", dated October 7, 1992, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. Approval of HDP 91-23 is granted subject to the approval of SUP 92-1. 3. All of the conditions of Planning Commission Resolution 3437, SUP 92-1, are hereby incorporated by reference. ... . .. ... ... ... I*( ...
