PLANNING COMMISSION RESOLUTION NO. 3456
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, UPHOLDING THE
PLANNING DIRECTOR’S DECISION TO CAUSE THE DENIAL
OF A BUILDING PERMIT FOR THE CONSTRUCTION OF A
SINGLE-FAMILY RESIDENCE AT 6504 OCEANVIEW DRIVE.
CASE NAME: STANLEY BUILDING PERMIT
CASE NO: CB 91-1590 (APPEAL)
WHEREAS, a verified application for certain property to wit:
6504 Oceanview Drive, Solamar Mobile Home Park, Carlsbad
California,
has been filed with the City of Carlsbad and referred to the Planning Commission; a
WHEREAS, said verified application constitutes a request as provided
Title 18 of the Carlsbad Municipal Code; and
WHEREAS, in order for the City to approve said application, it mi
determine that the application is consistent with all laws and ordinances of the City; a
WHEREAS, the Planning Department reviewed the said application fo;
consistency with Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 21st day of October, 191
and on the 18th day of November, 1992, hold a duly noticed public hearing as prescril
by law and to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering
testimony and arguments, if any, of all persons desiring to be heard, said Comrniss
considered all factors relating to CB 91-1590.
NOW THEREFORE, BE IT HEREBY RESOLVED by the Planning Commiss
of the City of Carlsbad as follows:
A) That the above recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Commissio

3. The Planning Director has determined that the proposed conventional woo
framed residential structure is not in compliance with the permitted uses in tE
RMHP Zone, Chapter 21.37 of the Carlsbad Municipal Code.
4. The Planning Commission concurs with the conclusions of the State Departmctl
of Housing and Community Development, the Citfs Building Official and Pld
Director, that the proposed structure could not meet the definition of a mob2
home or manufactured housing and is therefore not consistent with Chapter 21 -3
(CMC).
