CASE NAME: NAVARRA CONDOMINIUMS CASE NO. CT 89-24x1 WHEREAS, The Planning Commission did, on August 1, 1990, adopt Planni Commission Resolution No. 3066 approving a tentative map for a one lot, eight u: I 7 8 condominium subdivision known as CT 89-24, and WHEREAS, said tentative map will have expired as of August 1 , 1992, and 9 WHEREAS, the Applicant has requested an extension of time to process toward a fi~ lo map, and 11 WHEREAS, The Applicant has been diligently pursuing those acts required to obtai, 12 13 14 WHEREAS, The project can be found to be in conformance with the General Plan, Ti 15 21, other City ordinances and current City policies with the imposition of additiol 16 conditions, and 17 WHEREAS, the Applicant has agreed to the imposition of the additional conditic 18 which are needed to bring the tentative map into conformance with the General Plan, Ti 21, other City ordinances and current City policies; final map, and 19 2o I 21 /I NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the CiQ 22 1. That the above recitations are true and correct. 23 Carlsbad, California as follows: 25 2. The design and improvements of the project are consistent with the Gent 24 Plan, Title 20, Title 21, other City ordinances and current City policies with the imposit 26 of additional conditions. 27 28 3, That the Applicant has been diligently pursuing those acts necessary to ob1 0 e I/ a final map. 1 2 I/ 4. That the request for an extension of time for the tentative map for Carlsb 3 1993, subject to all the original conditions of approval of Planning Commission Resoluti 4 Tract 89-24 be APPROVED for a period of one year from August 1, 1992 until August 5 NO. 3066 with the following modifications and the following additional conditions: 6 Deleted Condition 7 11 1. Condition No. 60 is deleted. 8 9 Modified Conditions 10 11 12 13 14 2. Condition No. 58 is modified to read in its entirety: "Approval of this tentative map shall expire August 1, 1993 unless a fi map is recorded. An extension may be requested by the Applicant. S extension shall be approved or denied at the sole discretion of the Plann: Commission. In approving an extension, the Planning Commission n impose new conditions and may revise existing conditions pursuant Section 20.12.110(a)(2) of the Carlsbad Municipal Code. 15 11 3. Condition No. 4 is modified to read in its entirety: 16 17 18 19 I "This project is approved upon the express condition that building pern will not be issued for development of the subject property unless respective district furnishing sewer or water service determines that wa service and sewer facilities are available at the time of application for SI water service and sewer permits and will remain available until time occupancy. A note to this effect shall be placed on the final map. 20 21 22 23 24 25 26 27 Additional Conditions: 4. The Applicant is aware that the City is preparing an in-lieu or housing imr fee program as an alternate to the inclusionary requirements stipulatec Policy 3.6b of the Housing Element. If in the development of the in-lieu program, it is determined by the City Council in order to find consiste with the Housing Element of the General Plan as well as consistency v Section 66473.5 of the Government Code (Subdivision Map Act), that project is subject to either fee and building permits have not been issued, Applicant or its successors in interest shall pay whatever fee that is requi and in effect at the time of issuance of building permits. The applicant shall defend, indemdfy and hold harmless the City and i agents, officers, and employees from any claim, action or proceeding again the City or its agents, officers, or employees to attack, set aside, void or nl an approval of the City, the Planning Commission or City Engineer which h, been brought against the City within the time period provided for by Sectic 66499.37 of the Subdivision Map Act. 4 I1 - 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 6. The owner of the subject property shall execute a Hold Harmless Agreeme regarding drainage across the adjacent property prior to approval of the fin map for this project. 7. The applicant shall comply with the City's requirements of the Nation Pollutant Discharge Elimination System (NPDES) permit. The applica shall provide best management practices to reduce surface pollutants to i acceptable level prior to discharge to sensitive areas. Plans for SUI final map, issuance of grading or building permit, whichever occurs first. 8. Prior to issuing a building permit for this project the Applicant shall pay growth management fee of $ 310 per dwelling unit as enacted by Cj Council Resolution No. 88-53 on February 23, 1988. improvements shall be approved by the City Engineer prior to approval of tl 9. Prior to issuing a building permit for this project the Applicant shall subn to the Planning Director for processing and approval a colored reclaim1 water use area map. PASSED, APPROVED AND ADOPTED at regular meeting of the Carlsbad Plannil Commission held on the 18th day of November, 1992, by the following vote, to wit: AYES: Chairperson Erwin, Commissioners: Schlehuber, Schram Noble, Welshons, Savary & Hall.
