PLANNING COMMISSION RESOLUTION NO. 3466
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING AN EXTENSION OF TIME
FOR A TENTATIVE MAP.

WHEREAS, The Planning Commission did, on August 1, 1990 adopt Plannir
Commission Resolution No. 3070 approving a tentative map for a 13 lot subdivision knov
as CT 89-38, and
WHEREAS, said tentative map will have expired as of August 1, 1992, and
WHEREAS, the Applicant has requested an extension of time to process toward
final map, and
WHEREAS, The Applicant has been diligently pursuing those acts required to obta
a final map, and
WHEREAS, The project can be found to be in conformance with the General Pla
Title 21, other City ordinances and current City policies with the imposition of additior
conditions, and
WHEREAS, the Applicant has agreed to the imposition of the additional conditio
which are needed to bring the tentative map into conformance with the General Plan, Ti
21, other City ordinances and current City policies;
NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City
Carlsbad, California as follows:
1. That the above recitations are true and correct.
2. The design and improvements of the project are consistent with the Gene
Plan, Title 20, Title 21, other City ordinances and current City polices with the impositi

the following modifications and the following additional conditions:

3. Prior to the recordation of the final tract map or issuance of building permi
whichever is first, the owner of record of the property within the boundar
of this subdivision shall prepare and record a notice (Form Noise 2)that tl

5. Condition No. 54 is modified to read in its entirety:

"Approval of this tentative map shall expire August 1, 1993 unless a fir
map is recorded. An extension may be requested by the Applicant. Sz
extension shall be approved or denied at the sole discretion of the Planni
Commission. In approving an extension, the Planning Commission m
impose new conditions and may revise existing conditions pursuant
Section 20.12.110(a)(2) of the Carlsbad Municipal Code.

7. The Applicant is aware that the City is preparing an in-lieu or housing imp2
fee program as an alternate to the inclusionary requirements stipulated
Policy 3.6b of the Housing Element. If in the development of the in-lieu f
or impact fee program, it is determined by the City Council in order to fi
consistency with the Housing Element of the General Plan as well
consistency with Section 66473.5 of the Government Code (Subdivision M;
Act), that this project is subject to either fee and building permits have n
been issued, the Applicant or its successors in interest shall pay whatever f
that is required and in effect at the time of issuance of building permits.

9. The applicant shall comply with the City's requirements of the Nation

acceptable level prior to discharge to sensitive areas. Plans for su(
improvements shall be approved by the City Engineer prior to approval of tl
final map, issuance of grading or building permit, whichever occurs first.
PASSED, APPROVED AND ADOPTED at regular meeting of the Carlsbad Plannir
Commission held on the 18th day of November 18, 1992, by the following vote, to wit
