PLANNING COMMISSION RESOLUTION NO. 3467
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING AN
CARLSBAD BOYS AND GIRLS . CLUB ON PROPERTY
GENERALLY LOCATED ON THE WEST SIDE OF CENTELLA
STREET AT ITS SOUTHERN TERMINUS.
CASE NAME: CARLSBAD BOYS AND GIRLS CLUB
EXTENSION OF CONDITIONAL USE PERMIT 87-5 AT THE
CASE NO: CUP 87-05x1
WHEREAS, a verified application has been filed with the City of Carlsb:
and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided 1
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Plannir
Commission did, on the 2nd day of December, 1992, hold a duly noticed public heari~
to consider said application on property described as:
Lot 180 of Map No. 8059 in the City of Carlsbad, County of
San Diego, filed on July 22, 1975.
WHEREAS, at said public hearing, upon hearing and considering ~
testimony and arguments, if any, of all persons desiring to be heard, said Commissi(
considered all factors relating to CUP 87-05x1.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissil
of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commissi
APPROVES CUP 87-05x1, based on the following findings and subject to t
following conditions:

Findins:
1. That the requested use is necessary or desirable for the development of tl
community, is essentially in harmony with the various elements and objectives
the general plan, and is not detrimental to existing uses or to uses specifical
permitted in the zone in which the proposed use is to be located because the u continues to operate in compliance with all conditions of approval and does n
intrude onto adjacent properties.
2. That the site for the intended use is adequate in size and shape to accommodz
the use because there has been no expansion of the use from its original appro1
in 1987.
3. That all of the yards, setbacks, walls, fences, landscaping, and other featul
necessary to adjust the requested use to existing or permitted future uses in t
neighborhood will be provided and maintained because all origjnally res&
features were provided and have been maintained.
4. That the street system serving the proposed use is adequate to properly handle
traffic generated by the proposed use because no additional new trips are bei
generated and adequate parking is still being provided.
5. That the use has adequate supervision on site.
Conditions:
1. Approval of CUP 87-05x1 is granted subject to all conditions of CUP 874
Planning Commission Resolution No. 2661, incorporated herein by reference a
on file in the Planning Department, except Condition No. 8 which is replaced
Condition No. 2 below and Condition No. 16 which is replaced by Condition P
3 below.
2. This conditional use permit is granted for a period of five years five months a
twenty-nine days from the date of expbtion, or from June 3, 1992,
December 2,1997. This conditional use permit shall be reviewed by the Planti
Director on a yearly basis to determine if all conditions of this permit have bc
met and that the use does not have a significant detrimental impact
surrounding properties or the public health and welfare. If the Planning Direc
determines that the use has such significant adverse impacts, the Planning Direc
shall recommend that the Planning Commission, after providing the permittee.

not been met. This permit may be extended for a reasonable period of time n
to exceed five (5) years upon written application of the permittee made no le
than 90 days prior to the expiration date. In granting such extension, the Plannil
Commission shall find that no substantial diverse effect on surrounding land us
or the public’s health and welfare will result because of the continuation of t:
permitted use. If a substantial adverse effect on surrounding land uses or t
public’s health and welfare is found, the extension shall be considered as ;
original application for a conditional use permit. There is no limit to the numb
of extensions the Planning Commission may grant.
3. Hours of operation shall be as follows:
a. 7:OO a.m. to 6:OO p.m. Monday through Friday;
b. The facility shall be closed on Saturdays and Sundays and during a
church services; an&
C. A maximum of 48 children shall be allowed at any one time.
4. The fadity shall have adequate supervision on site.
5. The applicant shall construct a fence acceptable to the Planning Director along t
western edge of the property by April 15,1993. If such fence is not construct
by April 15,1993, this project shall be returned to the Planning Commission j
reconsideration.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planni
Commission of the City of Carlsbad, California, held on the 2nd day of December, 195
by the following vote, to wit:
AYES: Chairperson Erwin, Commissioners: Schlehuber, Schram
Noble, Welshons, Savary & Hall.
NOES: None.
ABSENT: None.
ABSTAIN: None.
