PLANNING COMMISSION RESOLUTION NO. 3472
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
VARIANCE TO ALLOW A REDUCED FRONT YARD SETBACK
GENERALLY LOCATED 3083 AND 3085 OCEAN STREET.
CASE NAME: SHULTZ/LESLIE ADDITION

WHEREAS, a verified application for certain property, to wit:

has been filed with the City of Carlsbad, and referred to the Planning Commission; ant
WHEREAS, said verified application constitutes a request as provided b
12 WHEREAS, the Planning Commission did, on the 6th day of January, 1993

18 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio

22 APPROVES V 92-02, based on the following findings and subject to the

Findinm:
1. The following exceptional circumstances and conditions which force th
construction of garages into front yard setbacks are applicable to this site: steq bluffs which limit automobile access to the eastern third of the lot between Oceiu
Street and the top of the bluff; limited buildable area due to structural setback
required by the Local Coastal Plan; the high density General Plan designatia
allowing multiple units with onsite parking requirements; the predominance c
reduced front yard setbacks in the area primarily for the purpose of providin
covered and uncovered parking to serve multiple units.
2. The variance is necessary for the preservation and enjoyment of a substantk
property right possessed by other property in the same vicinity and zone since du
to the lot constraints described above, the majority of lots located seaward c
Ocean Street south of Carkbad Viiage Drive provide garages or parking structurf
within the fkont yard setback to serve multiple units.
3. The granting of this variance will not be materially detrimental to the pub1
welfare or injurious to the property in question since similar development to th; proposed has already been established in the area.
4. The addition of a single story garage in the front yard setback and a redwood de(
will not impact the General Plan since the existing two-unit condominium
consistent with the high density General Plan designation specified for the beac
area.
Conditions:
1. Approval is granted for V 92-02, as shown on Exhibit(s) "A"-"G", dated Janua:
6, 1993, incorporated by reference and on file in the Planning Departmer
Development shall occur substantially as shown unless otherwise noted in the:
conditions.
2. The garage doors shall be equipped with automatic roll up doors. No pad- parking in front of the garages shall be permitted.
3. Any obstruction to access of the guest parking space such as landscaping or fend
is strictly prohibited.
4. Approval of V 92-02 is granted subject to the approval of SDP 92-02.
5. AU conditions imposed by Planning Commission Resolution No. 3471 approvi
SDP 92-07 are incorporated herein by reference. ....
