CASE NAME: CANYON PACIFIC CITY OF CARLSBAD, CALIFORNIA, APPROVING A NON- CASE NO: PUD 92-07 WHEREAS, a verified application for certain property to wit: 8 Lots 10-13, Carlsbad Oaks Business Center, Carlsbad Tract 74- 21, 9 10 has been filed with the City of Carlsbad and referred to the Planning Commission; and 11 WHEREAS, said verified application constitutes a request as provided by Ti 12 14 WHEREAS, the Planning Commission did, on the 6th day of January, 195 13 21 of the Carlsbad Municipal Code; and hold a duly noticed public hearing as prescribed by law to consider said request; and 15 16 WHEREAS, at said public hearing, upon hearing and considering all testimo 17 and arguments, if any, of all persons desiring to be heard, said Commission considered 18 19 factors relating to the Tentative Tract Map and Planned Unit Development. as follows: 20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissi 21 A) That the above recitations are true and correct. 22 B) That based on the evidence presented at the public hearing, the Commissj 23 24 APPROVES PUD 92-07, based on the following findings and subject to the followj conditions: 25 .... 26 .... 27 28 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 ~ 18 19 I Fink: 1. The granting of this pennit will not adversely affect and will be consistent with t code, the general plan, applicable specific plans, master plans, and all adopted pla of the city and other governmental agencies. 2. The proposed use at the particular location is necessary and desirable to providt service or facility which will contribute to the general well-being of t neighborhood and the community. 3. The proposed use will not be detrimental to the health, safety or general welfare persons residing or working in the vicinity, or injurious to property or improveme1 in the vicinity. 4. The proposed nonresidential planned development meets all of minim^ development standards of the underlying zone, except for lot area. 5. The structures being converted meet present City building regulations. 6. All of the findings of CT 92-06, Planning Commission Resolution No. 3473 a incorporated herein by reference. Conditions: 1.
